THE KENYA NATIONAL EXAMINATIONS COUNCIL (CONDUCT OF EXAMINATION) RULES
PART I – PRELIMINARY
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Conduct of Examinations) Rules, 2015.

2. |
Interpretation
In these Rules unless the context otherwise requires—
"appointed examination agent" means an agent appointed by the Council from other government establishments to administer Council examinations for, and on behalf of the Council;
"answer script" means a document or documents containing a candidate's response to examination questions;
"certificate of supervision" means a document indicating the record of events at an examination centre issued by a person appointed by the Council to perform the duties of supervision of an examination at that particular examination centre;
"commission" has the meaning assigned to it under the Teachers Service Commission Act, 2012, (No. 20 of 2012);
"distribution centre" means a secure and safe storage facility outside the Council premises approved by the Council for the storage of examination materials;
"examination session" means the prescribed time within which an examination paper is to be taken by candidates as set out in the respective examination timetable;
"examination centre" means an institution or premises approved and registered by the Council for purposes of administering Council examinations;
"examination period" includes the time when the Council is in the process of printing, packing, distributing, administering, marking and processing any examination administered by the Council;
"examination timetable" means the schedule and programme prescribing the session and time within which a series of Council examination papers are to be taken by the candidates;
"head of institution" means the head of a school or an academic institution and includes director or manager administrator of an institution;
"principal" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"head-teacher" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"identification badge" means a document for identifying a Council official or authorised agents of the Council or the Teachers Service Commission County Director, County Director of Education or their authorised agents;
"invigilator" means a person appointed by the Council or its authorised agent to assist in the supervision of examination administration at a designated examination centre;
"Kenya Mission" means Kenya's High Commission or Embassy:
"random number" means a temporary and unsystematic number issued by the Council to conceal the identity of an examination;
"question paper envelope" means the envelope used to seal and secure Council examinations materials;
"script control form" means a record where candidates sign as evidence of having taken a Council examination paper;
"stimulus material" means any unauthorised material including but not limited to visual aids, diagrams and diagram, charts, apparatus that contain any content of any subject that may be found in an examination room or centre;
"supervisor" means a person appointed by the Council or its authorised agent to be in-charge of examination administration processes at a designated examination centre;
"photograph register" means a record with photographs of candidates registered to sit an examination at a particular examination center;
"year of examination" means the calendar year in a particular Council of Examination is administered.

PART II – CONDUCT OF EXAMINATION
3. |
Examination Agents
(1) |
The Council may conduct examinations directly or use appointed examination agents.
|
(2) |
The Council shall develop a mechanism for operationalizing the agency system.
|
(3) |
The Council shall implement and manage the agency system.
|
(4) |
(a) |
County Directors of Education;
|
(b) |
Teachers Service Commission County Directors;
|
(c) |
National Security Agencies; or
|
(d) |
such other person as the Council may determine as its agents from time to time.
|
|
(5) |
A government establishment, organization or individual appointed as a Council agent shall—
(a) |
be responsible to the Council; and
|
(b) |
act in accordance with the requirements of the Act, other written law, these Rules and Council examination regulations.
|
|
|
4. |
Role of the County Director of Education
(1) |
The County Director of Education shall—
(a) |
report to the Council on all matters related to the examinations administered by the Council;
|
(b) |
recommend the opening of new distribution centres;
|
(c) |
ensure that an examination center has the required facilities and a conducive environment for administration of the examination;
|
(d) |
coordinate the deployment of education officers managing distribution centers to be used during the administration of the examinations;
|
(e) |
oversee and coordinate the transportation of question papers from the distribution centers to an examination center and back;
|
(f) |
liaise with the National Government and the County Governments for provision of security officers to ensure the security of question papers and other examination materials at drop off points, on transit, at distribution and examination centers;
|
(g) |
oversee the preparation of fuel estimates based on distance;
|
(h) |
ensure prudent use of Council resources and surrender of imprest according to Council and Government policy and regulations;
|
(i) |
jointly with Teachers Service Commission County Directors brief the agents appointed to perform an examination administration functions before the start of the examination;
|
(j) |
oversee the collection of question papers, stationery and other related examination materials at the Council's designated drop off points to a distribution center;
|
(k) |
oversee the proper management of a distribution center and security of examination materials;
|
(l) |
oversee the issuing of question papers and stationery to the supervisors at distribution centers;
|
(m) |
ensure that examinations are conducted in accordance with the Act, these Rules and Council regulations and any other written law;
|
(n) |
ensure the candidates sitting examination under special circumstances have a conducive environment;
|
(o) |
manage data of all agents appointed to perform examination administration functions;
|
(p) |
oversee the safe return of all examination materials to the Council offices;
|
(q) |
oversee the receipt and dissemination of all circulars on supervision and invigilation;
|
(r) |
ensure the safe return of answer scripts from an examination center to a distribution center;
|
(s) |
monitor the supervisors and invigilators during the conduct of the examinations in the respective County to ensure that the examination is conducted according to the Council's regulations; and
|
(t) |
perform such other duties the Council may determine from time to time.
|
|
(2) |
The County Director of Education may delegate any responsibility to a senior officer in the County in accordance with the Act, other written law, these Rules and Council examination regulations.
|
|
5. |
Role of Teachers Service Commission County Director
(1) |
Teachers Service Commission County Director shall—
(a) |
report to the Council on all matters related to examinations administered by the Council;
|
(b) |
coordinate the generation and verification of the data base for deployment of supervisors and invigilators to ensure that all supervisors and invigilators are registered with the Teachers Service Commission and meet the qualifications specified in these Rules and Council regulations;
|
(c) |
oversee the deployment of supervisors and invigilators to examinations centre using the database provided by the Council before the start of an examination;
|
(d) |
jointly with County Directors of Education brief agents appointed to perform examination administration functions before the start of the examination;
|
(e) |
verify the payment claims for supervision and invigilation before submission to the Council; and
|
(f) |
oversee submission of queries related to supervision and invigilation to the Council;
|
(g) |
monitor the conduct and ensure discipline of principals, head teachers, teachers, supervisors, invigilators and all Teachers Service Commission staff deployed to manage examinations; and
|
(h) |
take appropriate action according to the Act, the Teachers Service Commission Act, any other written law, these Rules against any Teachers Service Commissionstaff or registered person involved in examination irregularities or malpractices;
|
|
(2) |
The Teachers Service Commission County Director may delegate a responsibility to Senior Officers in the respective County in accordance with these Rules, the Act, any other written laws and Council regulations.
|
|
6. |
Role of Education Officer manning distribution centre
(1) |
An education officer manning a distribution centre shall be answerable to the County Director of Education.
|
(2) |
An education officer manning a distribution centre shall—
(a) |
receive all the expected examination materials from the County Director of Education at a distribution centre;
|
(b) |
confirm that the examination materials are intact at the point of receipt, at the distribution centre and on every day of examination;
|
(c) |
vet supervisors using every supervisor's—
(i) |
identification badge; |
(ii) |
appointment letter; and |
(iii) |
national identity card before issuing the examination materials; |
|
(d) |
ensure that examination materials, bags, boxes, caskets and chemicals are opened in the presence of supervisors and security officers escorting examination materials to an examination centre;
|
(e) |
ensure that containers with examination materials for the specific examination day as indicated on the examination timetable are opened and that question paper packets are issued after confirmation of the details on the packet;
|
(f) |
monitor the security of the examination materials stored at the distribution centre throughout the examination period;
|
(g) |
ensure that all return envelopes containing candidates' answer scripts are sealed at the end of each day;
|
(h) |
ensure that armed security officers are available to escort supervisors leaving a distribution centre with examination question papers, stationery and other examination materials;
|
(i) |
maintain a detailed and accurate records of examination materials issued and received from an examination centre;
|
(j) |
account for any evidence of an examination irregularity received at the end of each examination day, forward the evidence of the irregularities to the Council at the end of the examination or within such timelines as Council may determine.
|
|
|
7. |
Role of security agent in charge of a distribution centre
A security agent in charge of a distribution centre shall—
(a) |
be responsible to the Education Officer manning distribution centre and the Security Officer in-charge of the station;
|
(b) |
oversee the receipt of examination materials from the Council at the distribution centres and confirm that the containers are safe, secure, and intact;
|
(c) |
ensure the security of examination materials while the materials are stored at the distribution centre;
|
(d) |
deploy security officers to be in charge of the armoury and appoint other security officers to escort examination materials from the distribution centre to the examination centre and back;
|
(e) |
provide armed security officers to escort examination materials from the distribution centre back to the Council; and
|
(f) |
ensure that all the containers with examination materials are sealed at the end of each examination day in the presence of respective security officers.
|
|
8. |
Role of security agent escorting examination materials
A security agent in charge of a distribution centre shall—
(a) |
confirm that the containers for examinations are secure and intact before departure to the drop off points;
|
(b) |
ensure the security of examination materials while on transit to drop off points or distribution centres;
|
(c) |
secure and witness the off loading and handing over of examination materials at a drop off point or distribution centre and confirm that the containers are safe, secure and intact.
|
|
9. |
Role of security agent in charge of armoury or strongroom
A security agent in charge of the armoury or strong-room shall—
(a) |
witness the receipt of examination materials from the Council at the distribution centres and confirm that the containers are safe secure and intact before the containers are stored in the armoury or strong room;
|
(b) |
ensure the security of examination materials while they are stored at the armoury or strong-room;
|
(c) |
verify and witness that the containers are intact before they are opened;
|
(d) |
witness the opening of the containers and issuing of examination materials to supervisors by the Education Officer managing the distribution centre; and
|
(e) |
witness the sealing of the containers after enclosing the return envelopes containing answer sheets at the end of the examination day.
|
|
10. |
Role of a security agent escorting examination materials from a distribution centre to an examination centre and back
(1) |
Examination materials shall be escorted by an armed security officer from distribution centre and back to the armoury.
|
(2) |
A security agent escorting examination materials from a distribution centre to an examination centre and back shall—
(a) |
witness the taking over of examination materials by a supervisor from the education officer managing the distribution centre and sign the accountability tracking form;
|
(b) |
ensure the security of the examination materials on transit from distribution centres to examination centres and back;
|
(c) |
witness that question paper packets are intact at the point of opening before distribution of the question papers to the candidates by the supervisors;
|
(d) |
witness the counting of the spare question papers, ensuring that they are all put back in the question paper packet;
|
(e) |
remain within the examination centre at a vantage position to ensure proper conduct and security of examinations;
|
(f) |
witness the collection, receipt, counting and enclosure of the candidates' answer scripts into the return envelope and sealing them while in the examination room in full view of the candidates;
|
(g) |
witness the receipt of answer scripts by the education officer managing the distribution centre and signing the relevant accountability tracking forms on the return of examination materials to the distribution centre.
|
|
|
11. |
Role of a head of institution
(1) |
A head of an institution shall be responsible for accurately registering eligible candidates by ensuring that—
(a) |
the institution is an approved examination centre with the required facilities for all subjects offered for the relevant Council examination;
|
(b) |
candidates being registered for the examination are eligible;
|
(c) |
candidates are correctly categorized as first attempt or repeaters;
|
(d) |
all registered candidates meet the minimum examination entry qualifications specified by the Council;
|
(e) |
subject entry requirements are met as spelt out in respective examination regulations and curriculum;
|
(f) |
all eligible candidates are registered for the examination and accurate examination fees fully paid in the mode prescribed by the Council;
|
(g) |
candidates' registration details are accurately captured in the mode prescribed by the Council;
|
(h) |
the candidates are entered for the correct subjects and paper codes as given in the respective examination regulations and syllabus;
|
(i) |
the original evidence of payment of examination fees is forwarded to the Council together with other relevant registration documents;
|
(j) |
all registered candidates sit examinations as prescribed by the Council; and
|
(k) |
impersonation does not take place.
|
|
(2) |
A head of institution who fails to register a qualified candidate for a particular Council examination commits an offence and is liable upon conviction, to imprisonment for a term not exceeding one year or a fine not exceeding five hundred thousand shillings or to both fine and imprisonment.
|
|
12. |
Qualifications of a supervisor
A person qualifies for recruitment as a supervisor if that person—
(a) |
is a secondary school trained teacher and or a public service employee in Job group K and above in case of Kenya Certificate of Primary Education and post school examinations;
|
(b) |
has a minimum experience of three years as an invigilator;
|
(c) |
meets the requirements of Chapter Six of the Constitution of Kenya;
|
(d) |
is a teacher who is an employee of or registered by the Teachers Service Commission;
|
(e) |
is a P1 teacher with five years teaching experience in the case of supervision of Kenya Certificate of Primary Education Examination;
|
(f) |
is a trained Technical Teacher with a minimum qualification of Technician III Certificate in the case of supervision of Technical Examination;
|
(g) |
any other qualification as may be determined by the Council from time to time.
|
|
13. |
Role of a supervisor
(a) |
visit the allocated examination centre at least a day before the start of the examination and carry out the following duties—
(i) |
request to be allocated a room with a lockable cabinet or cupboard by the head of the institution for storage of examination materials other than the question papers and answer scripts during the examination period; |
(ii) |
brief and assign duties to the invigilators on what is expected of them during the examination period; |
(iii) |
inspect examination rooms to ascertain that they meet the specification prescribed by the Council and are free of stimulus materials and ensure that the desks or tables are arranged as per the Council's specifications; |
(iv) |
request the head of institution for all the materials or equipment required to administer the examination as prescribed in these Rules and Council Regulations; |
(v) |
ensure that only registered candidates sit the examination; |
(vi) |
brief candidates on how to conduct themselves during the examinations; |
|
(b) |
be at the distribution centre at the time prescribed by the Council to pick the examinations materials;
|
(c) |
witness the opening of examination containers at the distribution centre every day of the examination;
|
(d) |
collect question papers as prescribed by the Council from the distribution centre and ensure security of the same when on transit to the examination centre and while the examination is in progress;
|
(e) |
inspect the examination rooms every day before the start of the examinations to ensure that they meet the specifications prescribed by these Rules and Council Regulations and there are no unauthorized or stimulus materials in the examination room;
|
(f) |
ensure that all candidates are positively identified against the photograph register and Council registration data;
|
(g) |
supervise the search of candidates as they enter the examination rooms for every examination session and ensure that female candidates are searched by a female officer or teacher while male candidates are searched by a male officer or teacher;
|
(h) |
ensure that the candidates, invigilators, head of institution and security officer inspect the question paper packets and sign the declaration to witness that they are intact before opening;
|
(i) |
open the examinations question paper packet in front of the candidates and ensure at least one of the candidates countersigns the envelope as evidence of witnessing the opening;
|
(j) |
count the question papers to ensure they are adequate before the invigilator issues them to the candidates;
|
(k) |
start the examination on time as specified in the respective examination timetable and ensure that the examination lasts for the period scheduled on the examination timetable;
|
(l) |
staple the question paper packet with spare question papers to ensure the packet is sealed then place the packet on a desk in front of the candidates inside the examination room;
|
(m) |
ensure that the examination is conducted as per the Act, written law, these Rules and Council regulations;
|
(n) |
prepare a report on any examination irregularity and ensure that any confiscated materials are sealed and handed over to the education officer managing the distribution centre;
|
(o) |
ensure that all examination irregularity materials collected at the examination center are forwarded with a report to the Council;
|
(p) |
inform the security officer to arrest any of the candidates or any other person involved in any criminal activities prescribed in the Act, these Rules and other written laws;
|
(q) |
inspect the washrooms before they are used by candidates;
|
(r) |
closely monitor candidates' inside and outside the examination room during the examination session;
|
(s) |
escort and search a candidate who visits the washrooms or any other premise before re-entering the examination room;
|
(t) |
ensure that the institution's centre number is boldly written in an appropriate position where all candidates can see;
|
(u) |
ensure that candidates use the index number issued by the Council as per the approved list;
|
(v) |
ensure candidates write their answers using the writing materials prescribed by the Council;
|
(w) |
ensure that no person including the supervisor, invigilator, heads of institutions and candidate enters the examination room with mobile phone or any other electronic communication devices;
|
(x) |
ensure that no unauthorized persons have access to question papers while the examination is in progress;
|
(y) |
ensure that the invigilators do not explain the questions to candidates, read or allow any person to read the candidates' responses;
|
(z) |
ensure that the script control form is signed by all candidates before the end of the examination session where applicable;
|
(aa) |
ensure the question papers for the following sessions and answer scripts for the preceding sessions are placed at a desk in front of the candidates while the examination is in session;
|
(bb) |
Collect, count, and put all the candidates' answer scripts and duly signed script control form in the official Council script return envelope and seal the return envelope in full view of the candidates, head of institution and security officer;
|
(cc) |
ensure that the declaration on the return envelope is duly filled in the presence of the candidates, invigilators, head of institution and security officer as provided for in the return envelope containing candidates' answer scripts;
|
(dd) |
ensure that no candidate's answer scripts are left behind by physically counting the number of candidates present against the number of answer scripts collected at the end of every examination session;
|
(ee) |
ensure that the spare question papers are only given to the head of institution at the end of the day when every candidates' answer script has been sealed in the return envelopes;
|
(ff) |
receive question papers that might have errors or blank pages from invigilators and record the details in the Report and Certificate of Supervision;
|
(gg) |
enclose the Report and Certificate of Supervision in the return envelope and hand it over to the officer managing the distribution centre for submission to the Council;
|
(hh) |
prevent the occurrence of examination irregularities in the examination centre and if such cases arise, handle them as stipulated in the Act, these Rules and Council regulations;
|
(ii) |
return every candidates' answer scripts securely to the distribution centre after each day of the examination and sign the relevant accountability documents;
|
(jj) |
keep an accurate record of work allocated to invigilators on a daily basis;
|
(kk) |
accurately complete the Attendance Sheets, Report and Certificate of Supervision, Seating Plans, Declaration Form for Payment and any other documents required then submit the documents to the Council through the officer managing the distribution centre;
|
(ll) |
ensure that no candidate who is more than half an hour late after the start of the examination is given a question paper unless cleared by the Council;
|
(mm) |
ensure that all reports of hardship cases which might have affected candidates' work during the examination and which are related to the conduct of the examination are indicated in the and certificate of supervision;
|
(nn) |
in consultation with County Director of Education ensure that candidates taking examinations under special circumstances have a conducive environment;
|
(oo) |
submit to the officer managing the distribution centre answer scripts of candidates taking examinations under special circumstances in a special envelope separately;
|
(pp) |
ensure that a candidate whose name is not on the attendance list sits the examination with the express authority of the Council or an education officer authorized by the Council; and
|
(qq) |
insert the omitted candidate details on the approved candidates list where authority to sit the examination is granted.
|
|
14. |
Qualifications of an Invigilator
A person may be qualified for recruitment as an invigilator if that person—
(a) |
is a trained teacher with qualifications of P 1 grade or higher and are employed or registered by the Teachers Service Commission;
|
(b) |
is a trained teacher of a minimum of Approved Teachers Status grade and employed or registered by the Teachers Service Commission; or
|
(c) |
a teacher of shorthand for purposes of shorthand examinations;
|
(d) |
is a person of integrity as stated in Chapter Six of the Constitution of Kenya ; or
|
(e) |
has at least one year experience as a teacher; and
|
(f) |
any other qualification prescribed the Council
|
|
15. |
Role of an Invigilator
(a) |
report to the assigned examination centre a day before the start of the relevant examination and carry out assignment of duties by the supervisor;
|
(b) |
report any irregularity at the examination room or centre to the supervisor ;
|
(c) |
inspect the examination rooms assigned every day before the examination starts to ensure that there are no unauthorized materials or stimulus materials in the examination room or on the candidates' desks or tables;
|
(d) |
inspect the washrooms before being used by candidates;
|
(e) |
closely monitor candidates inside and outside the examination room;
|
(f) |
escort and search a candidate who visits the washrooms or any other premises before re-entering the examination room;
|
(g) |
search candidates each time they enter the examination room to prevent smuggling of unauthorized materials and stimulus materials including mobile phones or any other electronic communication devices into the room. Female candidates must be searched by a female supervisor or invigilator or teacher and male students must be searched by male supervisors or invigilators or teachers;
|
(h) |
receive the question papers from the Supervisor, checking to ensure that the paper is correct as per the timetable and count them to confirm that there are enough copies for all the candidates before distributing them;
|
(i) |
ensure that the examination starts promptly and lasts for the time scheduled on the examination timetable;
|
(j) |
hand over to the supervisor any paper with errors or blank pages;
|
(k) |
identify the candidates against the photograph register, as appropriate verifying the candidates' index numbers, names and ensure that the script control form is signed by all candidates before the end of the examination session;
|
(l) |
distribute question papers and answer booklets to candidates;
|
(m) |
collect and physically count candidates' answer scripts before releasing the candidates from the examination room at the end of an examination session;
|
(n) |
hand over candidates answer scripts at the end of each examination session to the supervisor for recording, packing and sealing in the return envelope;
|
(o) |
sign the declaration form in the Report and Certificate of Supervision;
|
(p) |
ensure that no unauthorized persons have access to question papers while the examination is in progress;
|
(q) |
mark 'AB' against the name of every candidate who is absent every session of the examination and account for every candidate using the attendance register;
|
(r) |
be vigilant to ensure that candidates do not engage in any kind of examination malpractices;
|
(s) |
must not explain the questions to the candidates, read or allow any person to read candidates' responses;
|
(t) |
ensure candidates write their answers in the writing materials prescribed by the Council;
|
(u) |
take note of the absent candidates' numbers and missed to be transferred to the computer printed attendance sheet and the script control form; and
|
(v) |
ensure that there is no discrepancy between the record of absenteeism, on the attendance register and the script control form.
|
|
16. |
Role of the Candidate
(a) |
register for the Council examination they intend to sit within the prescribed time;
|
(b) |
ensure that they present themselves in the examination room on the time prescribed by the Council;
|
(c) |
ensure that they allow a search to be conducted on them;
|
(d) |
witness and verify whether question papers are intact and sign the same before opening;
|
(e) |
witness the sealing of answer scripts;
|
(f) |
ensure that the spare question papers are placed in their sight; and
|
(g) |
ensure that they do not engage in any kind of examination irregularities.
|
|
17. |
Supervision Personnel and Field Officers
(1) |
A supervisor and invigilator may be posted to an examination centre close to their area of residence in order to minimize the time used to reach the examination centre.
|
(2) |
Supervision personnel shall not be deployed to an institution located within the same premises as the personnel's regular work station.
|
(3) |
Every distribution center shall be managed by at least—
(d) |
one education officer; and
|
(e) |
two security officers during the examinations;
|
(h) |
Every examination centre shall be managed by at least one security officer.
|
|
|
18. |
Deployment of supervisors
(1) |
A supervisor shall not be allocated to the same examination centre for more than two consecutive calendar years.
(a) |
Every examination centre shall have at least one supervisor;
|
(b) |
There shall be one supervisor for every two hundred candidates;
|
(c) |
There shall be an additional supervisor for any extra candidate above two hundred.
|
|
|
19. |
Deployment of invigilators
(1) |
Every examination room shall have at least one invigilator.
|
(2) |
There shall be an invigilator for every twenty candidates.
|

1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Kenya Certificate of Secondary Education Examinations) Rules, 2009.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Council" means the (Kenya National Examinations Council established the Kenya National Examinations) Council Act;
"examination centre" means the school or other centre recognised by the Council as a place at which candidates may sit for the examination;
"EACE examination" means the East African Certificate of Education examination;
"headteacher" means the headteacher of a secondary school;
"Kenya Mission" means Kenya’s Embassy or High Commission in a country outside Kenya;
"KCPE examination" means the Kenya Certificate of Primary Education examination;
KCSE examination" means the Kenya Certificate of Secondary Education examination;
"secondary school" means a school recognised by the Council as eligible to present candidates for the examinations;
"year of the examinations" means the year in which the candidate intends to sit for the examination.

3. |
Conditions for eligibility
(1) |
The examination shall be open to all bona-fide residents of Kenya who meet the examination entry requirements as stipulated by the Council.
|
(2) |
The examination shall be administered to eligible candidates within Kenya by the District Education Officers on behalf of the Council and in conformity with the Council’s Regulations for the conduct of public examinations.
|
(3) |
A Kenyan citizen resident in a country outside Kenya may sit for the KCSE
examination in countries, where—
(a) |
the Kenya Mission in that country makes a formal application to the Council six months before the year of the examination and undertakes to make the necessary local arrangements for conducting the examination;
|
(b) |
an examining body in that country which has formal collaboration with the Council undertakes to supervise the examination under Council regulations;
|
(c) |
(i) |
the entry requirements; |
(ii) |
the expenses for local administration of the examination in the country of residence; and |
(iii) |
the freight and correspondence expenses incurred by the Council for the purpose of the examination. |
|
|
(4) |
The Council shall reject applications made pursuant to sub-rule (3) which do not fulfill the requirements set out therein.
|
|
4. |
School Candidates
(1) |
A school candidate shall be a person who has studied continuously during the three years immediately preceding registration in a secondary school which is an examination centre and who continues in school after registration until he is presented by the headteacher for the examination.
|
(2) |
A school candidate shall enter for at least seven subjects as prescribed under Regulation 7.
|
|
5. |
Private candidates
(1) |
A person wishing to take the examination as a private candidate shall register for the examination same at the District Education Office in March of the year of the examination.
|
(2) |
A private candidate shall be considered for registration where he—
(a) |
is a holder of a KCSE, or an EACE school certificate with a minimum of Division IV or equivalent certification; or
|
(b) |
produces evidence of having spent at least three years after sitting the KCPE examination, and takes and passes the KCSE qualifying test administered by the Council, unless otherwise exempted by the Council;
|
(c) |
produces a school-leaving certificate from the last school attended;
|
(d) |
produces a letter of confirmation from the headteacher of the school where he intends to sit for the practical examination papers set out in the First Schedule:
|
Provided that arrangements for sitting the subjects specified in this subparagraph shall be responsibility of the candidate.
|
|
6. |
Repeaters
(1) |
A candidate may re-sit any number of subjects irrespective of the year when he first sat for the examination, as long as such subjects are offered in the current curriculum and examination, and that they are subjects taken in an earlier examination attempt.
|
(2) |
A candidate who is not graded for any reason in the first attempt at the examination, including a candidate whose results are cancelled due to examination irregularities, shall repeat the examination in all subjects previously taken:
Provided that such a candidate shall not be allowed to re-sit the examination until after the expiry of two years from the date of cancellation of the results.
|
(3) |
A supplementary certificate shall be issued to a candidate who resits less than seven subjects, indicating the subjects taken and the subject grades obtained.
|
(4) |
The grades obtained in a repeated examination shall not be used to re-compute the mean grade obtained at the initial examination.
|
(5) |
The Council shall not issue a combined single certificate to a repeating candidate.
|
|
7. |
Examinations subjects
The subjects to be taken in the examination and the entry requirements shall be as set out in the First Schedule.
|
8. |
Grading of results
The Council shall award results to candidates in the manner set out in the Second Schedule.
|
9. |
Certificates
(1) |
A certificate awarded to a candidate shall show the name of the candidate, the candidate’s index number, the name of the school in the case of a school candidate, and all the subjects taken by the candidate in the examination with the respective codes and the grades obtained in all the subjects taken.
|
(2) |
All certificates shall be issued to the headteachers and to private candidates through the Provincial Directors of Education or the District Education Officers.
|
(3) |
The Council may at any time withdraw a certificate for amendment or for any other reason where it considers it necessary.
|
|
10. |
Certifying Statements written
(1) |
The Council may forward a certifying statement of a candidate’s results upon written request, to an institution of higher learning, an employer or other public organisation.
|
(2) |
The request under subrule (1) shall indicate the candidate’s full name, the name of the school attended (if any), the year of the examination and the candidate’s index number.
|
(3) |
There shall be payable in respect of a statement of examination results under subrule (1) a search fee in an amount to be determined by the Council and communicated from time to time.
|
(4) |
A certifying statement shall be issued only on production of a letter from an individual or institution requesting for the same.
|
|
11. |
Notification of Results
(1) |
All results shall be issued through the Ministry as soon as the award and the processing of results are completed.
|
(2) |
There shall be printed for each examination centre a list of all candidates for the centre, showing the results of each candidate in every subject taken and a mean grade and aggregate points for the whole examination for each candidate.
|
(3) |
The Council may correct the information given under subrule (2) before certificates are issued, and the decisions of the Council and its examiners concerning the results shall be final.
|
|
12. |
Examination Centres
(1) |
The examination shall only be held in secondary schools registered as required by the Act and approved by the Council as examination centres.
|
(2) |
A registered secondary school wishing to enter candidates for the first time for the examination shall apply to the Council for registration as an examination centre through the District Education Officer and the Director of Quality Assurance and Standards at least six months before the year of the examination.
|
(3) |
An application under subrule (2) shall be accompanied by a certified copy of the certificate of registration of the school issued by the Ministry of Education.
|
(4) |
The Council may withdraw approval for an examination centre where it is satisfied that the centre does not comply with these rules or if the continuation of the institution as such centre would endanger the security of examinations, and combine examination centres for ease of administration of examinations and for security reasons.
|
|
13. |
Entry and other requirements
(1) |
Intending candidates who fulfil the entry requirements specified in rule 3 shall apply for registration by completing and submitting the prescribed entry forms, and paying the prescribed examination fees.
|
(2) |
School candidates shall be entered for registration for the examination by their headteachers.
|
(3) |
The headteacher shall ensure that candidates’ entries conform to the entry requirements stipulated by the Council and that they are correct in terms of the spellings of the candidates’ names and the subjects for which they are registered.
|
(4) |
A headteacher entering candidates for the examination may be required to produce the school records of their candidates, including admission registers, class record cards, letters of transfer, mark-sheets and report forms.
|
(5) |
No headteacher shall enter any person for the examination where that person does not meet the qualifications of a school candidate.
|
(6) |
All school candidates shall be required to continue attending school until they are presented by the headteacher for the examination.
|
(7) |
Entries for candidates shall be submitted to the Council by the 31st of March of the year of the examination.
|
(8) |
Notwithstanding subrule (7), entries from candidates received after 31st March but before the 31st May of the year of the examination may be considered for acceptance on payment of late registration fees to the Council.
|
(9) |
The Council shall prescribe the late registration fee referred to in subrule (7) and may from time to time review the amount of such fees.
|
(10) |
In order for registration to be considered complete, schools and candidates shall present all the required documentation, including evidence of payment of the required fees.
|
(11) |
District Education Officers and headteachers shall deliver registration documents by hand to the Council offices, and any registration materials sent by post shall be returned to the sender and candidates shall not be registered for the examination.
|
(12) |
A candidate shall ensure that his entry forms are in order and that his names are correctly recorded thereon.
|
(13) |
No alterations shall be made to registration documents after they are received by the Council except with the permission of the Council, and no alterations thereto shall be made after the results of the examination are released by the Council.
|
|
14. |
Transfer by candidates
(1) |
Candidates registered under a particular school or examination centre shall be required to take the examination at that centre.
|
(2) |
Notwithstanding subrule (1), a candidate may transfer from one centre to another with the authority of the Council for reasons accepted as adequate and on payment of such fee as may be determined by the Council.
|
(3) |
Requests for a transfer under subrule (2) shall be made by the headteacher on behalf of the candidate, and the fee under this section shall be subject to review from time to time.
|
|
15. |
Transfer by candidates
(1) |
The examination fees shall be determined by the Council and communicated to school candidates through their respective headteachers and to private candidates through the press or the offices of the Provincial Directors of Education or District Education Officers.
|
(2) |
The Council may from time to time review the examination fees.
|
|
16. |
Withdrawal from examination
(1) |
A candidate who withdraws from the examination shall be entitled to a refund of half the amount of the examination fees paid:
Provided that—
(a) |
the Council shall give such refund where the notice of withdrawal under subrule (2) is received before the candidate sits for any of the papers; and
|
(b) |
a candidate who sits for any of the papers before giving the notice of withdrawal shall not be entitled to any refund
|
|
(2) |
Where any candidate wishes to withdraw from the examination, the headteacher of such candidate shall send the notices of withdrawal to the Council through the District Education Officer.
|
(3) |
Where any candidate dies before or completing the examination, the Council shall upon receipt of written notice with supporting documents, make a full refund of the examination fees.
|
(4) |
All refunds of examination fees shall be made after the examination is completed and results released.
|
|
17. |
Examination Timetable
(1) |
The provisional examination timetable shall be published at least one year before the examination together with the guidelines.
|
(2) |
The Council shall ensure that the timetable is presented in such a way that there is no clash in the dates and papers to be taken.
|
(3) |
Notwithstanding subrule (1), no special arrangements shall be made to suit the convenience of candidates registered for examinations offered by other examining bodies.
|
(4) |
Copies of the final printed timetable shall be sent to schools through Provincial Directors of Education and District Education Officers one month before the start of the examination, and no alterations shall be made thereto without the express consent of the Council.
|
(5) |
Candidates and headteachers shall ensure that they obtain copies of the final timetable and that candidates present themselves for the examination on time.
|
(6) |
The time allowed for answering each paper shall be indicated on the examination papers and printed on the timetable, and shall not be varied.
|
(7) |
Where the time indicated in the timetable is different from that indicated on the question paper, the time on the question paper shall apply.
|
|
18. |
Practical/Project Assessment
Practical examinations in and assessment of projects in Agriculture, Home Science, Computer Studies, Art and Design, Woodwork, Metalwork, Building Construction, Music and Languages, shall, where applicable, take place in or before the month of October of the year of the examination, on dates to be communicated separately by the Council and which shall also be indicated on the examination timetable.

19. |
Examination arrangement for the disabled candidates
(1) |
The Council shall prepare in Braille the examination papers for visually handicapped candidates on the syllabi approved specially for the blind.
|
(2) |
Information in Braille indicating the index numbers of candidates, subjects, papers, set books and the degree of visual handicap shall be forwarded to the Council by headteachers through the Provincial Director of Education or District Education Officers at the time of registration of the candidates for the examination.
|
(3) |
The duration of the examination allowed for candidates may be varied at the discretion of the Council for spastic candidates where this is supported by evidence from a competent medical authority, and requests for such consideration shall be forwarded at the time of registration by the headteacher, giving such evidence and information as may be required by the Council.
|
(4) |
The Council shall prepare adapted question papers for candidates who are hearing impaired on the Adapted Syllabi for the Hearing Impaired.
|
|
20. |
Infectious Diseases
A candidate who has been exposed to any infectious disease shall not sit for the examination at an examination centre unless the candidate is out of quarantine.
|
21. |
Language of the examination
Answers to examination questions shall be written in the English Language except in examination questions in languages other than English, or as otherwise specified in the rubric of the question paper.
|
22. |
Materials and Equipment for the Examinations
(1) |
A school presenting candidates shall provide facilities, materials and equipment required for the examination, including laboratory equipment, chemicals, music and musical instruments, materials for use in Home Science, Agriculture, Industrial Education, Art and Design or Drawing, pens, pencils, erasers, computers, TV sets 21", DVD/VCD players and any other examination materials required.
|
(2) |
All scripts, projects and other materials submitted to the Council for the examination, both written and practical, shall be the property of the Council.
|
(3) |
The Council shall not accept responsibility for the loss of or damage to scripts, projects or coursework materials before they are received by the Council after the examination.
|
(4) |
Where an examination paper requires the use of mathematical tables, candidates shall use the Kenya National Examinations Council tables
|
(5) |
Candidates may use electronic calculators of the silent cordless and nonprogrammable type in answering questions unless specifically forbidden in the rubric of the paper, and candidates shall be required to state the type of calculator used.
|
(6) |
Schools shall be required to provide candidates with electronic calculators of the silent, cordless and non-programmable type of size 16 cm x 7.5 cm or less of the same make and possessing the following features only—
(a) |
The four basic keys viz addition, subtraction, multiplication and division;
|
(b) |
The trigonometric functions: Sine, cosine, tangent and their inverses;
|
(c) |
The square and square root, cube and cube root functions;
|
(e) |
The fractional, a b c key;
|
(f) |
The power, x y and inverse keys;
|
(g) |
The memory M and M+ keys;
|
(l) |
Degree and Radian mode; and
|
(m) |
Simple statistical operations.
|
|
(7) |
The calculators provided under subrule (6) shall not possess the following features—
(b) |
Drawing and storage of graphics;
|
(d) |
Algebraic storage facilities; or
|
(e) |
Any other programming facility.
|
|
(8) |
All students at an examination centre shall use calculators of the same make.
|
|
23. |
School assessment and other records
A headteacher may be requested to submit school assessment, or any other records of candidates for whom such information may be required by the Council.
|
24. |
Remarking of scripts and examination queries
(1) |
Any queries on results shall be made as soon as results are released, and in any case not later than the 30th April of the year following the year of the examination.
|
(2) |
Remarking of scripts may be undertaken by the Council at the written request of the headteachers who presented the candidate.
|
(3) |
Requests for remarking from a private candidate shall be channelled through the Provincial Directors of Education or the District Education Officers of the Ministry of Education
|
(4) |
The Council shall undertake to remark scripts only after satisfactory reasons are given by the requesting headteacher justifying the remarking of scripts for a candidate whose results have already been issued.
|
(5) |
The Council may reject any request for remarking where in its opinion, a strong case for the same has not been established.
|
(6) |
A request for remarking may be channelled through the Provincial Directors of Education or the District Education Officers together with the fee prescribed by the Council so as to reach the Council within thirty days of the date of release of results.
|
|
25. |
Under protest entries
(1) |
In order to correct an apparent error in the entry shown on the Attendance Sheet, a subject or paper of a subject not recorded may be taken by a candidate "Under Protest" under the following conditions—
(a) |
that an explanation is given in writing by the candidate or school head;
|
(b) |
that an "Under Protest" fee is paid for each candidate for each paper taken "Under Protest";
|
(c) |
that the question papers for the subject are available at the examination centre;
|
(d) |
that, for each subject and for each paper of a subject, the "Under Protest" scripts are handled as specified in the guidelines for the conduct of KCSE examination issued at the time of examination;
|
(e) |
that the written explanation and the fees payment slips are enclosed in a separate envelope and despatched to the Council at the time of the despatch of the subject scripts, with the separate envelope enclosed in the main script envelope for the centre.
|
|
(2) |
Notwithstanding subrule (1), the correct despatch of "Under Protest" scripts shall not be a guarantee of their acceptance and marking by the Council, and the "Under Protest" fees is not refundable.
|
(3) |
Use of the "Under Protest" procedure may lead to delay in the issue of results for such candidates.
|
(4) |
The "Under Protest" procedure shall not be used for the purposes of registering candidates not registered at the time prescribed by the Council for registration.
|
|
26. |
Cancellation of Examination results
(1) |
The Council may cancel results of the examination for any candidate or examination centre which it proves has been involved in any form of examination irregularity or malpractice.
|
(2) |
Any candidate whose results in any subject are cancelled shall be awarded a subject grade ‘Y’ and an overall result ‘Y’ in the entire examination.
|
(3) |
A candidate whose results are cancelled may not sit for any Council examination for a subsequent period of two (2) years, and shall then be required to re-sit the entire examination.
|
(4) |
The Council may remove any examination centre whose results are cancelled from the roll of the Council’s approved examination centers.
|
|
27. |
Withholding cancellation of results
(1) |
The Council may withhold results of the examination for any candidate or examination centre suspected of having been involved in any form of an examination irregularity or misconduct pending completion of investigations and the final disposal of any consequent disciplinary or other proceedings.
|
(2) |
Where the Council, is satisfied after an investigation that candidates or examination centres have been involved in any examination irregularity or misconduct, it shall cancel the results of such candidates or examination centres.
|
(3) |
Where the results of a candidate or examination centre have been cancelled, such candidate or examination centre shall be subject to the sanctions stated in rule 26:
Provided that where the Council finds, after investigation, that there were no irregularities or misconduct at an examination centre, it shall release the results of the students at that examination centre.
|
|
28. |
Widespread irregularities
(1) |
If the Council is satisfied that the examination at any examination centre has not been conducted in accordance with its guidelines or that there have been widespread irregularities at an examination centre, it may at its sole discretion cancel the results of candidates for the entire centre.
|
(2) |
Where results of candidates have been cancelled, such candidates shall be subject to the sanctions stipulated under rule 26.
|
|
29. |
Cancelled results
Scripts, projects and other examination materials submitted by candidates for the purpose of assessment and in relation to which irregularities are established by the Council and results cancelled shall not be made available for re-assessment.
|
30. |
Offences
(a) |
gains access to examination materials and knowingly reveals the contents, whether orally or in writing, to any unauthorized party, whether a candidate or not;
|
(b) |
willfully and maliciously damages examinations materials;
|
(c) |
not being registered to take a particular Council examination, with intent to impersonate, presents or attempts to present himself to take the part of an enrolled candidate; or
|
(d) |
possesses or presents a forged certificate or diploma, commits an offence and shall be liable on conviction to imprisonment for a term not exceeding twelve months or to a fine not exceeding five thousand shillings or to both.

Revocation of L.N. 18/1998
The Kenya National Examinations Council (Kenya Certificate of Secondary Education) Rules, 1998, are revoked.

Or Candidates who opt for subject code numbers 122 and 237, will offer 3 subjects from Group 1, one subject from Group 2, one subject from Group 3 and 2 others from Groups 3, 4, and 5.
Blind candidates will offer three (3) subjects in Group 1, Biology (code number 236) in Group 2 and One subject in Group 3 and any two other subjects selected from Groups 3, 4 and 5 Hearing Impaired candidates shall take three (3) subjects, 101 and 121 in Group 1 and 504 in group 1, Kenyan Sign Language in place of 102 (Kiswahili); two (2) subjects in Group 2; one (1) subject in Group 3 and any other subject chosen from Groups 2,3,4 and 5.

PART I – PRELIMINARY
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Confirmation of Examination Results and Issuance of Replacement Certificates) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act, 2012, (No. 29 of 2012);
"Certificate" means a document issued by the Council and designated as such showing the results obtained by a particular candidate in an examination;
"examination results" means the overall outcome of the grades attained by a candidate and released by the Council after a candidate has taken an examination conducted by the Council;
"result slip" means a document issued by the Council showing provisional examination results attained by a candidate in an examination;
"series of examination" means the month when a Council examination is to be taken.

PART II – CONFIRMATION OF EXAMINATION RESULTS
3. |
Confirmation of results
(1) |
The Council may issue upon request, a confirmation of Examination results relating to a candidates examination results to an institution of learning, an employer, a public organization or any other interested institution.
|
(2) |
The request under paragraph (1) shall be made through the prescribed form.
|
(3) |
The applicant shall indicate the candidate's full name, the name of the institution attended, the year of the examination and the series of examination, the name of the examination and the candidate's index number.
|
(4) |
An applicant under this rule shall—
(a) |
pay the fees prescribed for confirmation of examination results;
|
(b) |
provide the full address of the institution where the Council shall send the statement confirming the examination results;
|
(c) |
provide a copy of the certificate of the candidate whose results they seek to confirm; and
|
(d) |
State the reason for requesting the confirmation of examination results.
|
|
|
4. |
Fees
(1) |
An application for confirmation of examination results shall be accompanied by the original evidence of payment of the prescribed fees for confirmation of examination results.
|
(2) |
The fees paid in rule 3(4) shall be utilized within ninety (90) days of payment failure to which the fees will be forfeited.
|
(3) |
The Council may review the fees for confirmation of examination results from time to time.
|
|
5. |
Confirmation
The Council shall send a statement confirming examination results within ten working days of receiving an application and all other relevant documents.
|
6. |
Restriction of use of confirmation results
A confirmation of examination results statement shall only be used by the institution to which it is addressed and shall not be copied or transferred to any other body or institution.
|
7. |
Authenticity of certificates
(1) |
Where the Council has issued a certificate and where the authenticity of that certificate is in doubt, the user, institution, body or person shall verify the authenticity of that certificate with the Council.

(2) |
A user institution, body or person shall report any person who presents or is in possession of a forged certificate to the police.
|
|
PART III – REPLACEMENT OF CERTIFICATES
8. |
Application for replacement of certificate
(1) |
A person may apply to the Council for the replacement of a lost or damaged certificate.
|
(2) |
An application for replacement of a certificate shall be made in the prescribed form.
|
(3) |
The applicant shall pay the prescribed fees for issuance of a replacement certificate.
|
(4) |
The application form shall be accompanied by the original evidence of payment of the prescribed fees as required in paragraph (3).
|
(5) |
The Council may review the fee for replacement certificates from time to time.
|
|
9. |
Documents accompanying application
An application for replacement of a certificate shall be accompanied by—
(a) |
a copy of the certificate or results slip where applicable;
|
(b) |
a letter of recommendation from the head of the institution where the applicant sat the specified examination;
|
(c) |
a letter of recommendation from the County Director of Education or his/her authorized agents for a private candidate or a candidate whose school has closed down;
|
(d) |
a letter of recommendation from the employer where applicable;
|
(e) |
a police abstract indicating loss of certificate provided that the report is made not more than seven days from the date the certificate is lost;
|
(f) |
an affidavit in support of the application; and
|
(g) |
the original copy of evidence of payment of the prescribed fees for confirmation of examination results.
|
|
10. |
Approval of replacement
An approval for a replacement of a certificate shall be verified and signed by the Chief Executive Officer of the Council.
|
11. |
Replacement of certificate
The replacement certificate shall be ready for collection within sixty working days from the date of receipt of an application subject to fulfill the conditions in sub-rule 9.
|
12. |
Collection of certificate
(1) |
The applicant shall be required to collect in person the replaced Certificate from the Council's designated office in person.
|
(2) |
The applicant shall be required to present their original national identification card or original passport for collection of the replaced certificate.
|
(3) |
The names on the identification documents presented in paragraph 2 shall conform to the names on the replaced certificate before the replaced certificate can be released to the person collecting the certificate.
|
(4) |
An applicant may with the approval of the Council nominate another person to collect the replaced certificate on their behalf, if they are out of the country.
|
(5) |
Where the applicant is a minor, a copy of the applicant's birth certificate and the national identification card of one of the parents or guardian shall be required.
|
(6) |
The names in the birth certificate presented in paragraph 5 shall conform to the names on the replaced certificate
|
|
13. |
Non collection of certificate
(1) |
Replaced certificates that are not collected within twenty four months from the date of application shall be disposed off by the Council without further communication to the applicant.
|
(2) |
The Council shall not refund application fees to an applicant who fails to collect a replaced certificate within twenty four months from the date of application.
|
|
14. |
Limitation on issuance of replacement certificates
(1) |
The Council shall only issue a replacement certificate for examinations sat from the year 1981 onwards.
|
(2) |
A replacement certificate shall only be issued once in a lifetime.
|
|
THE KENYA NATIONAL EXAMINATIONS COUNCIL (CONDUCT OF EXAMINATION) RULES
PART I – PRELIMINARY
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Conduct of Examinations) Rules.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"appointed examination agent" means an agent appointed by the Council from other government establishments to administer Council examinations for, and on behalf of the Council;
"answer script" means a document or documents containing a candidate's response to examination questions;
"certificate of supervision" means a document indicating the record of events at an examination centre issued by a person appointed by the Council to perform the duties of supervision of an examination at that particular examination centre;
"commission" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"distribution centre" means a secure and safe storage facility outside the Council premises approved by the Council for the storage of examination materials;
"examination session" means the prescribed time within which an examination paper is to be taken by candidates as set out in the respective examination timetable;
"examination centre" means an institution or premises approved and registered by the Council for purposes of administering Council examinations;
"examination period" includes the time when the Council is in the process of printing, packing, distributing, administering, marking and processing any examination administered by the Council;
"examination timetable" means the schedule and programme prescribing the session and time within which a series of Council examination papers are to be taken by the candidates;
"head of institution" means the head of a school or an academic institution and includes director or manager administrator of an institution;
"principal" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"headteacher" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"identification badge" means a document for identifying a Council official or authorised agents of the Council or the Teachers Service Commission County Director, County Director of Education or their authorised agents;
"invigilator" means a person appointed by the Council or its authorised agent to assist in the supervision of examination administration at a designated examination centre;
"Kenya Mission" means Kenya's High Commission or Embassy:
"random number" means a temporary and unsystematic number issued by the Council to conceal the identity of an examination;
"question paper envelope" means the envelope used to seal and secure Council examinations materials;
"script control form" means a record where candidates sign as evidence of having taken a Council examination paper;
"stimulus material" means any unauthorised material including but not limited to visual aids, diagrams and diagram, charts, apparatus that contain any content of any subject that may be found in an examination room or centre;
"supervisor" means a person appointed by the Council or its authorised agent to be in-charge of examination administration processes at a designated examination centre;
"photograph register" means a record with photographs of candidates registered to sit an examination at a particular examination center;
"year of examination" means the calendar year in a particular Council of Examination is administered.

PART II – CONDUCT OF EXAMINATION
3. |
Examination Agents
(1) |
The Council may conduct examinations directly or use appointed examination agents.
|
(2) |
The Council shall develop a mechanism for operationalizing the agency system.
|
(3) |
The Council shall implement and manage the agency system.
|
(4) |
(a) |
County Directors of Education;
|
(b) |
Teachers Service Commission County Directors;
|
(c) |
National Security Agencies; or
|
(d) |
such other person as the Council may determine as its agents from time to time.
|
|
(5) |
A government establishment, organization or individual appointed as a Council agent shall—
(a) |
be responsible to the Council; and
|
(b) |
act in accordance with the requirements of the Act, other written law, these Rules and Council examination regulations.
|
|
|
4. |
Role of the County Director of Education
(1) |
The County Director of Education shall—
(a) |
report to the Council on all matters related to the examinations administered by the Council;
|
(b) |
recommend the opening of new distribution centres;
|
(c) |
ensure that an examination center has the required facilities and a conducive environment for administration of the examination;
|
(d) |
coordinate the deployment of education officers managing distribution centers to be used during the administration of the examinations;
|
(e) |
oversee and coordinate the transportation of question papers from the distribution centers to an examination center and back;
|
(f) |
liaise with the National Government and the County Governments for provision of security officers to ensure the security of question papers and other examination materials at drop off points, on transit, at distribution and examination centers;
|
(g) |
oversee the preparation of fuel estimates based on distance;
|
(h) |
ensure prudent use of Council resources and surrender of imprest according to Council and Government policy and regulations;
|
(i) |
jointly with Teachers Service Commission County Directors brief the agents appointed to perform an examination administration functions before the start of the examination;
|
(j) |
oversee the collection of question papers, stationery and other related examination materials at the Council's designated drop off points to a distribution center;
|
(k) |
oversee the proper management of a distribution center and security of examination materials;
|
(l) |
oversee the issuing of question papers and stationery to the supervisors at distribution centers;
|
(m) |
ensure that examinations are conducted in accordance with the Act, these Rules and Council regulations and any other written law;
|
(n) |
ensure the candidates sitting examination under special circumstances have a conducive environment;
|
(o) |
manage data of all agents appointed to perform examination administration functions;
|
(p) |
oversee the safe return of all examination materials to the Council offices;
|
(q) |
oversee the receipt and dissemination of all circulars on supervision and invigilation;
|
(r) |
ensure the safe return of answer scripts from an examination center to a distribution center;
|
(s) |
monitor the supervisors and invigilators during the conduct of the examinations in the respective County to ensure that the examination is conducted according to the Council's regulations; and
|
(t) |
perform such other duties the Council may determine from time to time.
|
|
(2) |
The County Director of Education may delegate any responsibility to a senior officer in the County in accordance with the Act, other written law, these Rules and Council examination regulations.
|
|
5. |
Role of Teachers Service Commission County Director
(1) |
Teachers Service Commission County Director shall—
(a) |
report to the Council on all matters related to examinations administered by the Council;
|
(b) |
coordinate the generation and verification of the data base for deployment of supervisors and invigilators to ensure that all supervisors and invigilators are registered with the Teachers Service Commission and meet the qualifications specified in these Rules and Council regulations;
|
(c) |
oversee the deployment of supervisors and invigilators to examinations centre using the database provided by the Council before the start of an examination;
|
(d) |
jointly with County Directors of Education brief agents appointed to perform examination administration functions before the start of the examination;
|
(e) |
verify the payment claims for supervision and invigilation before submission to the Council; and
|
(f) |
oversee submission of queries related to supervision and invigilation to the Council;
|
(g) |
monitor the conduct and ensure discipline of principals, headteachers, teachers, supervisors, invigilators and all Teachers Service Commission staff deployed to manage examinations; and
|
(h) |
take appropriate action according to the Act, the Teachers Service Commission Act, any other written law, these Rules against any Teachers Service Commissionstaff or registered person involved in examination irregularities or malpractices;
|
|
(2) |
The Teachers Service Commission County Director may delegate a responsibility to Senior Officers in the respective County in accordance with these Rules, the Act, any other written laws and Council regulations.
|
|
6. |
Role of Education Officer manning distribution centre
(1) |
An education officer manning a distribution centre shall be answerable to the County Director of Education.
|
(2) |
An education officer manning a distribution centre shall—
(a) |
receive all the expected examination materials from the County Director of Education at a distribution centre;
|
(b) |
confirm that the examination materials are intact at the point of receipt, at the distribution centre and on every day of examination;
|
(c) |
vet supervisors using every supervisor's—
(i) |
identification badge; |
(ii) |
appointment letter; and |
(iii) |
national identity card before issuing the examination materials; |
|
(d) |
ensure that examination materials, bags, boxes, caskets and chemicals are opened in the presence of supervisors and security officers escorting examination materials to an examination centre;
|
(e) |
ensure that containers with examination materials for the specific examination day as indicated on the examination timetable are opened and that question paper packets are issued after confirmation of the details on the packet;
|
(f) |
monitor the security of the examination materials stored at the distribution centre throughout the examination period;
|
(g) |
ensure that all return envelopes containing candidates' answer scripts are sealed at the end of each day;
|
(h) |
ensure that armed security officers are available to escort supervisors leaving a distribution centre with examination question papers, stationery and other examination materials;
|
(i) |
maintain a detailed and accurate records of examination materials issued and received from an examination centre;
|
(j) |
account for any evidence of an examination irregularity received at the end of each examination day, forward the evidence of the irregularities to the Council at the end of the examination or within such timelines as Council may determine.
|
|
|
7. |
Role of security agent in charge of a distribution centre
A security agent in charge of a distribution centre shall—
(a) |
be responsible to the Education Officer manning distribution centre and the Security Officer in-charge of the station;
|
(b) |
oversee the receipt of examination materials from the Council at the distribution centres and confirm that the containers are safe, secure, and intact;
|
(c) |
ensure the security of examination materials while the materials are stored at the distribution centre;
|
(d) |
deploy security officers to be in charge of the armoury and appoint other security officers to escort examination materials from the distribution centre to the examination centre and back;
|
(e) |
provide armed security officers to escort examination materials from the distribution centre back to the Council; and
|
(f) |
ensure that all the containers with examination materials are sealed at the end of each examination day in the presence of respective security officers.
|
|
8. |
Role of security agent escorting examination materials
A security agent in charge of a distribution centre shall—
(a) |
confirm that the containers for examinations are secure and intact before departure to the drop off points;
|
(b) |
ensure the security of examination materials while on transit to drop off points or distribution centres;
|
(c) |
secure and witness the off loading and handing over of examination materials at a drop off point or distribution centre and confirm that the containers are safe, secure and intact.
|
|
9. |
Role of security agent in charge of armoury or strongroom
A security agent in charge of the armoury or strong-room shall—
(a) |
witness the receipt of examination materials from the Council at the distribution centres and confirm that the containers are safe secure and intact before the containers are stored in the armoury or strong room;
|
(b) |
ensure the security of examination materials while they are stored at the armoury or strong-room;
|
(c) |
verify and witness that the containers are intact before they are opened;
|
(d) |
witness the opening of the containers and issuing of examination materials to supervisors by the Education Officer managing the distribution centre; and
|
(e) |
witness the sealing of the containers after enclosing the return envelopes containing answer sheets at the end of the examination day.
|
|
10. |
Role of a security agent escorting examination materials from a distribution centre to an examination centre and back
(1) |
Examination materials shall be escorted by an armed security officer from distribution centre and back to the armoury.
|
(2) |
A security agent escorting examination materials from a distribution centre to an examination centre and back shall—
(a) |
witness the taking over of examination materials by a supervisor from the education officer managing the distribution centre and sign the accountability tracking form;
|
(b) |
ensure the security of the examination materials on transit from distribution centres to examination centres and back;
|
(c) |
witness that question paper packets are intact at the point of opening before distribution of the question papers to the candidates by the supervisors;
|
(d) |
witness the counting of the spare question papers, ensuring that they are all put back in the question paper packet;
|
(e) |
remain within the examination centre at a vantage position to ensure proper conduct and security of examinations;
|
(f) |
witness the collection, receipt, counting and enclosure of the candidates' answer scripts into the return envelope and sealing them while in the examination room in full view of the candidates;
|
(g) |
witness the receipt of answer scripts by the education officer managing the distribution centre and signing the relevant accountability tracking forms on the return of examination materials to the distribution centre.
|
|
|
11. |
Role of a head of institution
(1) |
A head of an institution shall be responsible for accurately registering eligible candidates by ensuring that—
(a) |
the institution is an approved examination centre with the required facilities for all subjects offered for the relevant Council examination;
|
(b) |
candidates being registered for the examination are eligible;
|
(c) |
candidates are correctly categorized as first attempt or repeaters;
|
(d) |
all registered candidates meet the minimum examination entry qualifications specified by the Council;
|
(e) |
subject entry requirements are met as spelt out in respective examination regulations and curriculum;
|
(f) |
all eligible candidates are registered for the examination and accurate examination fees fully paid in the mode prescribed by the Council;
|
(g) |
candidates' registration details are accurately captured in the mode prescribed by the Council;
|
(h) |
the candidates are entered for the correct subjects and paper codes as given in the respective examination regulations and syllabus;
|
(i) |
the original evidence of payment of examination fees is forwarded to the Council together with other relevant registration documents;
|
(j) |
all registered candidates sit examinations as prescribed by the Council; and
|
(k) |
impersonation does not take place.
|
|
(2) |
A head of institution who fails to register a qualified candidate for a particular Council examination commits an offence and is liable upon conviction, to imprisonment for a term not exceeding one year or a fine not exceeding five hundred thousand shillings or to both fine and imprisonment.
|
|
12. |
Qualifications of a supervisor
A person qualifies for recruitment as a supervisor if that person—
(a) |
is a secondary school trained teacher and or a public service employee in Job group K and above in case of Kenya Certificate of Primary Education and post school examinations;
|
(b) |
has a minimum experience of three years as an invigilator;
|
(c) |
meets the requirements of Chapter Six of the Constitution of Kenya;
|
(d) |
is a teacher who is an employee of or registered by the Teachers Service Commission;
|
(e) |
is a P1 teacher with five years teaching experience in the case of supervision of Kenya Certificate of Primary Education Examination;
|
(f) |
is a trained Technical Teacher with a minimum qualification of Technician III Certificate in the case of supervision of Technical Examination;
|
(g) |
any other qualification as may be determined by the Council from time to time.
|
|
13. |
Role of a supervisor
(a) |
visit the allocated examination centre at least a day before the start of the examination and carry out the following duties—
(i) |
request to be allocated a room with a lockable cabinet or cupboard by the head of the institution for storage of examination materials other than the question papers and answer scripts during the examination period; |
(ii) |
brief and assign duties to the invigilators on what is expected of them during the examination period; |
(iii) |
inspect examination rooms to ascertain that they meet the specification prescribed by the Council and are free of stimulus materials and ensure that the desks or tables are arranged as per the Council's specifications; |
(iv) |
request the head of institution for all the materials or equipment required to administer the examination as prescribed in these Rules and Council Regulations; |
(v) |
ensure that only registered candidates sit the examination; |
(vi) |
brief candidates on how to conduct themselves during the examinations; |
|
(b) |
be at the distribution centre at the time prescribed by the Council to pick the examinations materials;
|
(c) |
witness the opening of examination containers at the distribution centre every day of the examination;
|
(d) |
collect question papers as prescribed by the Council from the distribution centre and ensure security of the same when on transit to the examination centre and while the examination is in progress;
|
(e) |
inspect the examination rooms every day before the start of the examinations to ensure that they meet the specifications prescribed by these Rules and Council Regulations and there are no unauthorized or stimulus materials in the examination room;
|
(f) |
ensure that all candidates are positively identified against the photograph register and Council registration data;
|
(g) |
supervise the search of candidates as they enter the examination rooms for every examination session and ensure that female candidates are searched by a female officer or teacher while male candidates are searched by a male officer or teacher;
|
(h) |
ensure that the candidates, invigilators, head of institution and security officer inspect the question paper packets and sign the declaration to witness that they are intact before opening;
|
(i) |
open the examinations question paper packet in front of the candidates and ensure at least one of the candidates countersigns the envelope as evidence of witnessing the opening;
|
(j) |
count the question papers to ensure they are adequate before the invigilator issues them to the candidates;
|
(k) |
start the examination on time as specified in the respective examination timetable and ensure that the examination lasts for the period scheduled on the examination timetable;
|
(l) |
staple the question paper packet with spare question papers to ensure the packet is sealed then place the packet on a desk in front of the candidates inside the examination room;
|
(m) |
ensure that the examination is conducted as per the Act, written law, these Rules and Council regulations;
|
(n) |
prepare a report on any examination irregularity and ensure that any confiscated materials are sealed and handed over to the education officer managing the distribution centre;
|
(o) |
ensure that all examination irregularity materials collected at the examination center are forwarded with a report to the Council;
|
(p) |
inform the security officer to arrest any of the candidates or any other person involved in any criminal activities prescribed in the Act, these Rules and other written laws;
|
(q) |
inspect the washrooms before they are used by candidates;
|
(r) |
closely monitor candidates' inside and outside the examination room during the examination session;
|
(s) |
escort and search a candidate who visits the washrooms or any other premise before re-entering the examination room;
|
(t) |
ensure that the institution's centre number is boldly written in an appropriate position where all candidates can see;
|
(u) |
ensure that candidates use the index number issued by the Council as per the approved list;
|
(v) |
ensure candidates write their answers using the writing materials prescribed by the Council;
|
(w) |
ensure that no person including the supervisor, invigilator, heads of institutions and candidate enters the examination room with mobile phone or any other electronic communication devices;
|
(x) |
ensure that no unauthorized persons have access to question papers while the examination is in progress;
|
(y) |
ensure that the invigilators do not explain the questions to candidates, read or allow any person to read the candidates' responses;
|
(z) |
ensure that the script control form is signed by all candidates before the end of the examination session where applicable;
|
(aa) |
ensure the question papers for the following sessions and answer scripts for the preceding sessions are placed at a desk in front of the candidates while the examination is in session;
|
(bb) |
Collect, count, and put all the candidates' answer scripts and duly signed script control form in the official Council script return envelope and seal the return envelope in full view of the candidates, head of institution and security officer;
|
(cc) |
ensure that the declaration on the return envelope is duly filled in the presence of the candidates, invigilators, head of institution and security officer as provided for in the return envelope containing candidates' answer scripts;
|
(dd) |
ensure that no candidate's answer scripts are left behind by physically counting the number of candidates present against the number of answer scripts collected at the end of every examination session;
|
(ee) |
ensure that the spare question papers are only given to the head of institution at the end of the day when every candidates' answer script has been sealed in the return envelopes;
|
(ff) |
receive question papers that might have errors or blank pages from invigilators and record the details in the Report and Certificate of Supervision;
|
(gg) |
enclose the Report and Certificate of Supervision in the return envelope and hand it over to the officer managing the distribution centre for submission to the Council;
|
(hh) |
prevent the occurrence of examination irregularities in the examination centre and if such cases arise, handle them as stipulated in the Act, these Rules and Council regulations;
|
(ii) |
return every candidates' answer scripts securely to the distribution centre after each day of the examination and sign the relevant accountability documents;
|
(jj) |
keep an accurate record of work allocated to invigilators on a daily basis;
|
(kk) |
accurately complete the Attendance Sheets, Report and Certificate of Supervision, Seating Plans, Declaration Form for Payment and any other documents required then submit the documents to the Council through the officer managing the distribution centre;
|
(ll) |
ensure that no candidate who is more than half an hour late after the start of the examination is given a question paper unless cleared by the Council;
|
(mm) |
ensure that all reports of hardship cases which might have affected candidates' work during the examination and which are related to the conduct of the examination are indicated in the and certificate of supervision;
|
(nn) |
in consultation with County Director of Education ensure that candidates taking examinations under special circumstances have a conducive environment;
|
(oo) |
submit to the officer managing the distribution centre answer scripts of candidates taking examinations under special circumstances in a special envelope separately;
|
(pp) |
ensure that a candidate whose name is not on the attendance list sits the examination with the express authority of the Council or an education officer authorized by the Council; and
|
(qq) |
insert the omitted candidate details on the approved candidates list where authority to sit the examination is granted.
|
|
14. |
Qualifications of an Invigilator
A person may be qualified for recruitment as an invigilator if that person—
(a) |
is a trained teacher with qualifications of P1 grade or higher and are employed or registered by the Teachers Service Commission;
|
(b) |
is a trained teacher of a minimum of Approved Teachers Status grade and employed or registered by the Teachers Service Commission; or
|
(c) |
a teacher of shorthand for purposes of shorthand examinations;
|
(d) |
is a person of integrity as stated in Chapter Six of the Constitution of Kenya ; or
|
(e) |
has at least one year experience as a teacher; and
|
(f) |
any other qualification prescribed the Council.
|
|
15. |
Role of an Invigilator
(a) |
report to the assigned examination centre a day before the start of the relevant examination and carry out assignment of duties by the supervisor;
|
(b) |
report any irregularity at the examination room or centre to the supervisor ;
|
(c) |
inspect the examination rooms assigned every day before the examination starts to ensure that there are no unauthorized materials or stimulus materials in the examination room or on the candidates' desks or tables;
|
(d) |
inspect the washrooms before being used by candidates;
|
(e) |
closely monitor candidates inside and outside the examination room;
|
(f) |
escort and search a candidate who visits the washrooms or any other premises before re-entering the examination room;
|
(g) |
search candidates each time they enter the examination room to prevent smuggling of unauthorized materials and stimulus materials including mobile phones or any other electronic communication devices into the room. Female candidates must be searched by a female supervisor or invigilator or teacher and male students must be searched by male supervisors or invigilators or teachers;
|
(h) |
receive the question papers from the Supervisor, checking to ensure that the paper is correct as per the timetable and count them to confirm that there are enough copies for all the candidates before distributing them;
|
(i) |
ensure that the examination starts promptly and lasts for the time scheduled on the examination timetable;
|
(j) |
hand over to the supervisor any paper with errors or blank pages;
|
(k) |
identify the candidates against the photograph register, as appropriate verifying the candidates' index numbers, names and ensure that the script control form is signed by all candidates before the end of the examination session;
|
(l) |
distribute question papers and answer booklets to candidates;
|
(m) |
collect and physically count candidates' answer scripts before releasing the candidates from the examination room at the end of an examination session;
|
(n) |
hand over candidates answer scripts at the end of each examination session to the supervisor for recording, packing and sealing in the return envelope;
|
(o) |
sign the declaration form in the Report and Certificate of Supervision;
|
(p) |
ensure that no unauthorized persons have access to question papers while the examination is in progress;
|
(q) |
mark 'AB' against the name of every candidate who is absent every session of the examination and account for every candidate using the attendance register;
|
(r) |
be vigilant to ensure that candidates do not engage in any kind of examination malpractices;
|
(s) |
must not explain the questions to the candidates, read or allow any person to read candidates' responses;
|
(t) |
ensure candidates write their answers in the writing materials prescribed by the Council;
|
(u) |
take note of the absent candidates' numbers and missed to be transferred to the computer printed attendance sheet and the script control form; and
|
(v) |
ensure that there is no discrepancy between the record of absenteeism, on the attendance register and the script control form.
|
|
16. |
Role of the Candidate
(a) |
register for the Council examination they intend to sit within the prescribed time;
|
(b) |
ensure that they present themselves in the examination room on the time prescribed by the Council;
|
(c) |
ensure that they allow a search to be conducted on them;
|
(d) |
witness and verify whether question papers are intact and sign the same before opening;
|
(e) |
witness the sealing of answer scripts;
|
(f) |
ensure that the spare question papers are placed in their sight; and
|
(g) |
ensure that they do not engage in any kind of examination irregularities.
|
|
17. |
Supervision Personnel and Field Officers
(1) |
A supervisor and invigilator may be posted to an examination centre close to their area of residence in order to minimize the time used to reach the examination centre.
|
(2) |
Supervision personnel shall not be deployed to an institution located within the same premises as the personnel's regular work station.
|
(3) |
Every distribution center shall be managed by at least—
(a) |
one education officer; and
|
(b) |
two security officers during the examinations.
|
|
(4) |
Every examination centre shall be managed by at least one security officer.
|
|
18. |
Deployment of supervisors
A supervisor shall not be allocated to the same examination centre for more than two consecutive calendar years.
(a) |
Every examination centre shall have at least one supervisor;
|
(b) |
There shall be one supervisor for every two hundred candidates;
|
(c) |
There shall be an additional supervisor for any extra candidate above two hundred.
|

19. |
Deployment of invigilators
(1) |
Every examination room shall have at least one invigilator.
|
(2) |
There shall be an invigilator for every twenty candidates.

THE KENYA NATIONAL EXAMINATIONS COUNCIL (EQUATION OF CERTIFICATES) RULES
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Equation of Certificates) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act (No. 29 of 2012);
"certificate" means a document issued by a recognised examination body and designated as such showing the results obtained by a particular candidate in a designated examination;
"equation" means converting a genuine certificate issued by a recognised examination body to the equivalence of a Council certificate;
"equation letter" means a letter issued by the Council pursuant to these Rules;
"examination" means an examination conducted under this Act by or on behalf of the Council;
"foreign certificate" means a certificate obtained for an examination conducted by a foreign examination body; and
"method for conversion" means the criteria for converting a genuine certificate issued by a recognized examination body to the equivalence of a Council certificate.

3. |
Equation of certificates
The Council may equate school and post school certificates if the applicant meets the conditions prescribed in these Rules.
|
4. |
Equitable certificates
The Council may equate a certificate awarded by an authorized education body under the Act and mandated to offer examinations, award certificates and diplomas
|
5. |
Foreign Certificates
A person holding a foreign certificate and seeking to join an institution offering a council examination shall obtain an equation from the Council before joining that institution.
|
6. |
Non-equitable certificates
The Council shall not equate—
(a) |
a certificate for a course offered within Kenya and identical or similar to that offered by the Council;
|
(b) |
foreign certificates awarded within Kenya; and
|
(c) |
any other certificate that in the opinion of the Council may be non-equitable.
|
|
7. |
Translation of certificates
A person applying for the equation of a certificate written in a language other than English or Kiswahili shall first have the certificate translated into English or Kiswahili by the Embassy or High Commission in Kenya of the country from which the certificate originates.
|
8. |
Verification
A person who is seeking for equation of a certificate shall present the original certificate and request the examination body that issued the certificate to confirm the results directly to the Council.
|
9. |
Application for equations
(1) |
The Council shall only equate a certificate where the applicant meets the entry requirements of the equivalent course offered by the Council at the time.
|
(2) |
An application for equation of a certificate shall be made in the prescribed form.
|
(3) |
The application shall be accompanied by—
(a) |
the original certificate; and
|
(b) |
the original document confirming payment of the prescribed equation fees.
|
|
(4) |
Where an original certificate is not available; a statement of verification of the examination results may be provided by the applicant.
|
(5) |
The Council may require an applicant to attach to the application form a letter from the —
(c) |
Ministry responsible for Education of the country where the certificate was issued giving a detailed report on the accreditation status of the examination body which issued the certificate.
|
|
(6) |
An application for equation of a certificate shall be made to the Council in writing and in the prescribed form stating the —
(a) |
purpose for which the certificate is to be equated;
|
(b) |
postal address of the institution or government department which requested for the equation; and
|
(c) |
relevant information required under the Act or any other written law.
|
|
|
10. |
Additional documents
The Council may request for the applicant to provide—
(a) |
a copy of the syllabus or curriculum supporting the qualification taken to show the course content; and
|
(b) |
a letter from the examination body giving details of the mode of assessment.
|
|
11. |
Existing method of conversion
The Council shall only equate a certificate where a method for conversion already exists and where the curriculum followed is known to the Council.
|
12. |
Equation of certificates
The Council shall, using the method of conversion, equate a certificate where the applicant has met all the requirements for equation.
|
13. |
Fees
(1) |
The Council shall charge a fee for every equation of a certificate in the manner determined by the Council from time to time.
|
(2) |
An applicant shall submit a copy of a deposit slip from a prescribed bank in respect of the payment of charge as evidence.
|
|
14. |
Replacement
(1) |
The Council may issue a replacement of an equation letter where the letter is lost or damaged.
|
(2) |
The Council shall charge a fee for the issuance of a replacement equation letter.
|
(3) |
The Council may review the fees charged for issuance of replacement equation letter from time to time.
|
|
15. |
Limitation of use
An equation letter shall only be used by the institution to which it is addressed.
|
THE KENYA NATIONAL EXAMINATIONS COUNCIL (CONFIRMATION OF EXAMINATION RESULTS AND ISSUANCE OF REPLACEMENT CERTIFICATES) RULES
PART I – PRELIMINARY
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Confirmation of Examination Results and Issuance of Replacement Certificates) Rules.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act (Cap. 214A);
"Certificate" means a document issued by the Council and designated as such showing the results obtained by a particular candidate in an examination;
"examination results" means the overall outcome of the grades attained by a candidate and released by the Council after a candidate has taken an examination conducted by the Council;
"result slip" means a document issued by the Council showing provisional examination results attained by a candidate in an examination;
"series of examination" means the month when a Council examination is to be taken.

PART II – CONFIRMATION OF EXAMINATION RESULTS
3. |
Confirmation of results
(1) |
The Council may issue upon request, a confirmation of Examination results relating to a candidates examination results to an institution of learning, an employer, a public organization or any other interested institution.
|
(2) |
The request under paragraph (1) shall be made through the prescribed form.
|
(3) |
The applicant shall indicate the candidate's full name, the name of the institution attended, the year of the examination and the series of examination, the name of the examination and the candidate's index number.
|
(4) |
An applicant under this rule shall—
(a) |
pay the fees prescribed for confirmation of examination results;
|
(b) |
provide the full address of the institution where the Council shall send the statement confirming the examination results;
|
(c) |
provide a copy of the certificate of the candidate whose results they seek to confirm; and
|
(d) |
State the reason for requesting the confirmation of examination results.
|
|
|
4. |
Fees
(1) |
An application for confirmation of examination results shall be accompanied by the original evidence of payment of the prescribed fees for confirmation of examination results.
|
(2) |
The fees paid in rule 3(4) shall be utilized within ninety (90) days of payment failure to which the fees will be forfeited.
|
(3) |
The Council may review the fees for confirmation of examination results from time to time.
|
|
5. |
Confirmation
The Council shall send a statement confirming examination results within ten working days of receiving an application and all other relevant documents.
|
6. |
Restriction of use of confirmation results
A confirmation of examination results statement shall only be used by the institution to which it is addressed and shall not be copied or transferred to any other body or institution.
|
7. |
Authenticity of certificates
(1) |
Where the Council has issued a certificate and where the authenticity of that certificate is in doubt, the user, institution, body or person shall verify the authenticity of that certificate with the Council.
|
(2) |
A user institution, body or person shall report any person who presents or is in possession of a forged certificate to the police.
|
|
PART III – REPLACEMENT OF CERTIFICATES
8. |
Application for replacement of certificate
(1) |
A person may apply to the Council for the replacement of a lost or damaged certificate.
|
(2) |
An application for replacement of a certificate shall be made in the prescribed form.
|
(3) |
The applicant shall pay the prescribed fees for issuance of a replacement certificate.
|
(4) |
The application form shall be accompanied by the original evidence of payment of the prescribed fees as required in paragraph (3).
|
(5) |
The Council may review the fee for replacement certificates from time to time.
|
|
9. |
Documents accompanying application
An application for replacement of a certificate shall be accompanied by—
(a) |
a copy of the certificate or results slip where applicable;
|
(b) |
a letter of recommendation from the head of the institution where the applicant sat the specified examination;
|
(c) |
a letter of recommendation from the County Director of Education or his/her authorized agents for a private candidate or a candidate whose school has closed down;
|
(d) |
a letter of recommendation from the employer where applicable;
|
(e) |
a police abstract indicating loss of certificate provided that the report is made not more than seven days from the date the certificate is lost;
|
(f) |
an affidavit in support of the application; and
|
(g) |
the original copy of evidence of payment of the prescribed fees for confirmation of examination results.
|
|
10. |
Approval of replacement
An approval for a replacement of a certificate shall be verified and signed by the Chief Executive Officer of the Council.
|
11. |
Replacement of certificate
The replacement certificate shall be ready for collection within sixty working days from the date of receipt of an application subject to fulfill the conditions in sub-rule 9.
|
12. |
Collection of certificate
(1) |
The applicant shall be required to collect in person the replaced Certificate from the Council's designated office in person.
|
(2) |
The applicant shall be required to present their original national identification card or original passport for collection of the replaced certificate.
|
(3) |
The names on the identification documents presented in paragraph 2 shall conform to the names on the replaced certificate before the replaced certificate can be released to the person collecting the certificate.
|
(4) |
An applicant may with the approval of the Council nominate another person to collect the replaced certificate on their behalf, if they are out of the country.
|
(5) |
Where the applicant is a minor, a copy of the applicant's birth certificate and the national identification card of one of the parents or guardian shall be required.
|
(6) |
The names in the birth certificate presented in paragraph 5 shall conform to the names on the replaced certificate
|
|
13. |
Non collection of certificate
(1) |
Replaced certificates that are not collected within twenty four months from the date of application shall be disposed off by the Council without further communication to the applicant.
|
(2) |
The Council shall not refund application fees to an applicant who fails to collect a replaced certificate within twenty four months from the date of application.
|
|
14. |
Limitation on issuance of replacement certificates
(1) |
The Council shall only issue a replacement certificate for examinations sat from the year 1981 onwards.
|
(2) |
A replacement certificate shall only be issued once in a lifetime.
|

1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Examination Fees and Other Charges) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"examination fees" means a fee charged by the Council to a person registering for a Council examination.
"chargeable service" means a service other than examination offered by the Council at a fee;
|
3. |
Charging of examination fees and other charges
(1) |
The Council shall charge fees for purpose of administering examinations and other chargeable services provided by the Council.
|
(2) |
The Council shall determine the fees charged for examinations and other chargeable services provided by the Council.
|
(3) |
The Council may review the examination fees and other charges from time to time.
|
(4) |
The Council shall publish examination fees and other charges charged by the Council.
|
|
4. |
Mode of payment
(1) |
The Council shall determine and communicate the mode of payment for the examination fees and other chargeable services offered by the Council.
|
(2) |
A person wishing to be registered as a candidate or seeking Council chargeable services shall pay the prescribed fees in the prescribed mode to the Council.
|
(3) |
A person that has made a payment to the Council shall present to the Council the original payment receipt as evidence of having made the payment.
|
|
5. |
Withdrawal from examinations
(1) |
The Council shall not refund a candidate any amount of examination fees paid if the candidate withdraws from an examination.
|
(2) |
Fees paid shall not be transferred to another candidate or carried forward to another examination year.
|
|
6. |
Transfer fees
A candidate, who wishes to transfer from one examination centre to another, shall pay a transfer fee prescribed by the Council within sixty days after the close of registration
|
7. |
Remarking fee
A candidate or an institution applying for remarking of the Council's examinations shall pay the prescribed examination remarking fees.
|
8. |
Chargeable services
The Council shall from time to time determine chargeable services.
|

1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Handling of Examination Irregularities) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act, 2012, (No. 29 of 2012);
"examination centre" means an institution or premises approved and registered by the Council for purposes of administration of a Council examination;
"examination irregularities/examination malpractices" means any action which contravenes the set rules and regulations for the conduct of examinations;
"examination room" means a classroom or a hall within an examination centre that has been designated for candidates to sit a Council examination and includes any other area that a candidate has access to during the examination;
"head teacher" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"Principal" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"post school examination" includes Business, Technical and Teacher Education Examinations administered by the Council;
"stimulus materials" means any unauthorised material including visual aids, diagrams, charts and apparatus that contain any content of any subject that may be found in an examination room or centre;
"unauthorized material" means any information or materials that a candidate is found with within an examination room or centre which a candidate is not allowed to have access to during the examination period;
"widespread examination irregularities" means casein instance where all the candidates in an examination centre are proven to have been involved in examination irregularities;
"year of examination" means the calendar year in which a particular Council examination is administered.

3. |
Examination irregularity and misconduct
(1) |
The Council shall prepare and circulate to candidates and examination officials, regulations governing the conduct of Council examinations.
|
(2) |
The Council shall take appropriate action against any candidate, person or any examination centre that is involved in an examination irregularity or malpractice.
|
|
4. |
The role of Principals and head teachers
(1) |
The principal or head teacher of an institution shall establish mechanisms to deter the commission of examination irregularities and malpractises.
|
(2) |
Any principal or head teacher who encounters any examination irregularity or malpractice shall take such action as is provided under the Act or any other written law, these Rules and Council Examination Regulations and report the matter to the Council.
|
(3) |
Any principal or head teacher who aids, abets, induces or acts in a manner that condones commission of examination irregularity or malpractice commits an offence.
|
|
5. |
Reports
(1) |
An authorized agent, supervisor, invigilator or Council officer monitoring the conduct of an examination shall make a written report on any examination irregularity—
(b) |
at an examination centre; or
|
(c) |
at any other place which comes to his or her attention.
|
|
(2) |
Any person who witnesses an examination irregularity shall report to the Council, an education officer or to the police.
|
(3) |
The Council may, before making a decision on any report received, subject the report to investigations.
|
(4) |
An examiner who notices an irregularity during the marking of an examination shall compile and submit a report to the Council.
|
|
6. |
Search and confiscation of unauthorized materials
(1) |
An officer of the Council, a security officer or any Council agent may conduct a search on a candidate, examination centre, or premises used for examination related purposes, if they have reason to believe that an examination irregularity may be taking place or has taken place.
|
(2) |
The head of an institution, supervisor, invigilator, security officer, a council agent or a Council officer shall confiscate any unauthorized material found in the possession of a candidate or any other person or within any examination centre or premise.
|
(3) |
A supervisor, invigilator, security officer, Council officer or any Council agent who confiscates unauthorized material under paragraph (2) shall keep such unauthorized materials confiscated as evidence of the irregularity.
|
(4) |
Any unauthorized material confiscated under paragraph (2) shall be forwarded to the Council and may be used as evidence of an examination irregularity.
|
(5) |
A person found with unauthorized examination materials may be forwarded to the police for investigations and prosecution in accordance to the Act and any other written law.
|
(6) |
Where confiscated materials are handed to the police for purpose of investigation and prosecution, the Council shall keep a record of all confiscated materials for purpose of accountability.
|
|
7. |
Investigations
(1) |
The Council shall conduct investigations into the reports on the alleged examination irregularity.
|
(2) |
The Council may use a candidate or candidate's school records to conduct investigations and make a decision.
|
(3) |
A report of the findings shall be prepared on any investigations carried out.
|
|
8. |
Withholding of results
The Council may withhold examination results for any candidate or examination centre suspected of having been involved in an examination irregularity or malpractice pending completion of investigations or disciplinary action or any other appropriate action.
|
9. |
Penalties
Where the Council is satisfied that a candidate has been involved in an examination irregularity or malpractice the Council may—
(a) |
expel the candidate from the examination, the examination room or centre;
|
(b) |
cancel any of the candidate's examination papers already done;
|
(c) |
cancel any of the candidate's results;
|
(d) |
deny the candidate entry into any subsequent examinations;
|
(e) |
report the matter to the police with a view of having the candidate investigated and charged for the offence; or
|
(f) |
take any other action that the Council may consider appropriate under the Act or any other written law.
|
|
10. |
Examination centre
(1) |
Where the Council is satisfied that—
(a) |
there has been widespread examination irregularities at an examination centre; or
|
(b) |
the circumstances in which an examination is conducted at an examination centre are unsatisfactory, the Council may cancel the entire examination conducted at the examination centre or any one or more papers or the results thereof in relation to all the candidates at the examination centre.
|
|
(2) |
The Council may, where the entire results are cancelled under paragraph (1), deregister an examination centre whose examination results may have been cancelled.
|
|
11. |
Notification of withheld or cancelled results
(1) |
A candidate or an examination centre whose, results are withheld or cancelled shall as soon as the results have been announced be informed, in writing, of the Council's decision through the respective County Director of Education or through any other means as the Council may determine from time to time.
|
(2) |
A candidate whose results are cancelled shall receive a result designated as "Y" in the subject cancelled and an overall result designated as "Y".
|
(3) |
A candidate who receives a result designated as "Y" shall not be awarded a certificate or diploma.
|
(4) |
Notwithstanding paragraph (2), a candidate in the Kenya Certificate of Primary Education examination shall receive a result of zero in the subject cancelled.
|
(5) |
Where a Kenya Certificate of Primary Education examination candidate is proved to have cheated in three or more subjects the candidate shall have an overall result of zero.
|
(6) |
A Kenya Certificate of Primary Education examination candidate with an overall result of zero shall not be awarded a certificate in that examination.
|
(7) |
The Council may in any subsequent registration recognize a Kenya Certificate of Primary Education candidate with a result of zero in any one or two subjects for purposes of registration.
|
|
12. |
Barring of candidates
A candidate whose examination results are cancelled may be prohibited from taking any Council's examination for three consecutive years.
|
13. |
Council management
(1) |
The Council's management shall, upon receiving report of examination irregularity in any examination, cause a report to be compiled and discussed by the management of the Council.
|
(2) |
The management of the Council shall submit the report on irregularity to the Examinations Management Committee.
|
|
14. |
Decision of the Examinations Management Committee
(1) |
Where the Examinations Management Committee is satisfied that the report presents satisfactory evidence of an examination irregularity, the results for the affected candidate shall be cancelled.

(2) |
A candidate whose results have been cancelled shall be informed in writing indicating the examination irregularity.
|
|
15. |
Review of cancelled examination results
(1) |
A candidate whose examination results have been cancelled may apply to the Council within thirty days after release of the results for a review of the Council's decision.
|
(2) |
An application for a review of cancelled results shall be made in writing and shall indicate clearly the grounds for requesting the review.
|
(3) |
The Council shall upon receiving an application, consider the application and respond, in writing, to the applicant within thirty days.
|
(4) |
Where the Council declines an application for review, the Council shall specify the reasons for declining the application for review of cancelled results.
|
|
16. |
Hearing of the application for review
(1) |
Where the Council considers that the grounds raised by the applicant warrant a review, the Council shall—
(a) |
communicate the decision in writing to the applicant; and
|
(b) |
may require the applicant to appear for a hearing of the application within ninety days of receipt of the council's communication.
|
(c) |
Where the Council is satisfied that the candidate has not been involved in any examination irregularity, the Council shall release the results to the candidate.
|
|
|
17. |
Cancelled results
Any examination results cancelled by the Council under these Rules shall not be re- assessed.
|
THE KENYA NATIONAL EXAMINATIONS COUNCIL (EXAMINATION FEES AND OTHER CHARGES) RULES
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Examination Fees and Other Charges) Rules.

2. |
Interpretation
In these Rules unless the context otherwise requires—
"examination fees" means a fee charged by the Council to a person registering for a Council examination.
"chargeable service" means a service other than examination offered by the Council at a fee;

Charging of examination fees and other charges
(1) |
The Council shall charge fees for purpose of administering examinations and other chargeable services provided by the Council.

(2) |
The Council shall determine the fees charged for examinations and other chargeable services provided by the Council.
|
(3) |
The Council may review the examination fees and other charges from time to time.
|
(4) |
The Council shall publish examination fees and other charges charged by the Council.
|
|
4. |
Mode of payment
(1) |
The Council shall determine and communicate the mode of payment for the examination fees and other chargeable services offered by the Council.
|
(2) |
A person wishing to be registered as a candidate or seeking Council chargeable services shall pay the prescribed fees in the prescribed mode to the Council.
|
(3) |
A person that has made a payment to the Council shall present to the Council the original payment receipt as evidence of having made the payment.
|
|
5. |
Withdrawal from examinations
(1) |
The Council shall not refund a candidate any amount of examination fees paid if the candidate withdraws from an examination.
|
(2) |
Fees paid shall not be transferred to another candidate or carried forward to another examination year.
|
|
6. |
Transfer fees
A candidate, who wishes to transfer from one examination centre to another, shall pay a transfer fee prescribed by the Council within sixty days after the close of registration

7. |
Remarking fee
A candidate or an institution applying for remarking of the Council's examinations shall pay the prescribed examination remarking fees.

8. |
Chargeable services
The Council shall from time to time determine chargeable services.

THE KENYA NATIONAL EXAMINATIONS COUNCIL (MANAGEMENT OF EXAMINATION) RULES
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Management of Examination) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act (No. 29 of 2012);
"attendance sheet" means an authentic record for all candidates that have sat a particular Council examination;
"County Director of Education" has the meaning assigned to it under the Basic Education Act, 2013;
"distribution centre" means a secure and safe storage facility outside the Council premises approved by the Council for the storage of examination materials;
"examination centre" means an institution or premises approved and registered by the Council for purposes of administering Council examinations;
"examination period" means and includes the time when the means and includes the time when the council is in the process of printing, packing, distributing, administering, marking and processing any examination administered by the Council;
"examination results" means the overall outcome of the grades attained by a candidate and released by the Council after a candidate has sat for an examination conducted by the Council;
"examination room" means that space, compound, premises, area within which a Council examination is being administered;
"head-teacher" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"institutional candidate" means a candidate registered for an examination the Council through an institution of learning;
"post school examination" includes but is not limited to Business, Technical and Teacher Education Examinations administered by the Council;
"pre-registration" means advance compilation of data for candidates who will sit for the Kenya Certificate of Primary Education and Kenya Certificate of Secondary examinations;
"principal" has the meaning assigned to it under the Teachers Service Commission Act (No. 20 of 2012);
"private candidate" means a candidate who is registered to sit an examination at a private centre;
"private centre" means an institution or premises which is approved and registered by the Council as a private examination centre for purposes of examination administration;
"registration period" means period prescribed for candidates registration for each examination offered by the Council;
"result slip" means a document issued by the Council showing the provisional examination results obtained by a candidate in an examination;
"rubric" means the rules or instructions on the cover page of an examination question paper and the answer scripts;
"year of examination" means the calendar year in which a particular Council examination is administered.

PART II – REGISTRATION
3. |
Distribution Centre
(1) |
The Council shall approve distribution centres for the purpose of storing examination materials.
|
(2) |
Council examination materials shall only be stored in Council approved distribution centres.
|
(3) |
Distribution centres shall be approved at least one year before they are used.
|
|
4. |
Approval of a distribution centre
(1) |
The Council shall approve a distribution centre which
(a) |
is a permanent structure;
|
(b) |
has burglar proof doors and windows;
|
(c) |
has secure storage facilities;
|
(d) |
has sufficient security officers;
|
(f) |
has capacity to store examination materials for examination centres to be served;
|
(g) |
is located in a conducive environment; and
|
(h) |
meets any other criteria that the Council may determine from time to time.
|
|
|
5. |
Distribution center
Notwithstanding paragraph (1), the Council may approve a distribution center subject to such conditions for use of such a distribution center as the Council may specify.
|
6. |
Opening of new distribution centres
(1) |
The County Director of Education shall recommend the opening of a new distribution centre for approval by the Council where the distance between a distribution centre and an examination centre is more than fifty kilometers.
|
(2) |
Notwithstanding paragraph (1), the Council may approve a new distribution center in areas of high candidature or areas that have been identified by the Council to be in need of a distribution center even when the distances are less than fifty kilometers.
|
|
7. |
Examination Centres
(1) |
The Council shall determine the minimum facilities required for registration of an examination center.
|
(2) |
The Council shall establish the criteria for inspection of an examination center.
|
(3) |
The Council may review the minimum facilities and criteria required for an examination center.
|
(4) |
A Council examination shall only be administered at an examination centre approved and registered by the Council.
|
(5) |
The Council may delegate the role of approval of examination centers to the County Directors of Education.
|
(6) |
An institution registered by the Ministry in-charge of Education that wishes to offer a Council examination for the first time, shall apply to the Council for registration as an examination centre at least one year before the year of examination.
|
(7) |
The application shall be sent to the Council through the respective County Director of Education.
|
(8) |
An application under paragraph (6) and (7) shall be accompanied by a valid registration certificate and an inspection report issued by the Ministry in-charge of Education through the County Director of Education.
|
(9) |
The Council may cause a centre to be inspected before it is approved and registered as an examination centre.
|
(10) |
Where the Council has received all relevant documents, supporting evidence and is satisfied that the application meets the minimum requirements for an examination centre, the Council shall approve, register and issue the centre with an examination centre code.
|
(11) |
An examination centre shall be required to have the required facilities, equipment and materials for administration of the relevant examination and be located in an environment conducive for the administration of examinations.
|
(12) |
The Council shall reserve the right to deregister or cancel the registration of an examination centre.
|
(13) |
The Council may suspend or deregister an approved examination centre—
(a) |
where the Council is satisfied that the centre does not comply with the Act, these Rules and or the Council's examination regulations; or
|
(b) |
where the continuation of the institution as an examination centre would endanger the security of examinations.
|
|
(14) |
The Council may merge examination centres for purposes of ease of administration of examinations and for security reasons.
|
(15) |
The Council may administer foreign examinations on behalf of a foreign examination body.
|
(16) |
The foreign examination administered under paragraph (15) shall be at an examination centre approved by the relevant foreign examination body and by the Council.
|
|
8. |
Minimum number of candidates
(1) |
An examination centre shall register a minimum of—
(a) |
fifteen candidates for school examination; and
|
(b) |
ten candidates for post school examinations.
|
|
(2) |
Any examination centre which registers less than the number of candidates stipulated in paragraph (1) and wishes to remain as an examination centre shall pay the cost of registering the minimum number of candidates required.
|
(3) |
The Council may review the minimum number of candidates for every examination centre from time to time.
|
|
9. |
Entry requirements
(1) |
(a) |
the Council shall specify the entry requirements for every examination offered by the Council;
|
(b) |
the Council may carry out pre-registration for Kenya Certificate of Primary Education and Kenya Certificate of Secondary Education examinations;
|
(c) |
the Council shall determine the time to carry out pre-registration.
|
(d) |
the Council may use the pre-registration data to confirm registration details of a candidate;
|
(e) |
a person that did not register during pre-registration, may be registered by the Council under such conditions to be determined by the Council;
|
(f) |
where a person does not register at the time of pre-registration, the person may be required to pay a penalty for registration;
|
(g) |
a penalty under paragraph (1) (f) shall be determined by the Council from time to time.
|
(h) |
Any person who uses undue influence or threats to register a candidate in an institution where the candidate has not been studying shall be guilty of an offence and shall be liable upon conviction to imprisonment for a term not exceeding six months or a fine not exceeding one hundred thousand shillings or both.
|
|
(2) |
A candidate who intends to sit for examinations shall fulfill all the entry requirements set by the Council for the relevant examination.
|
(3) |
A candidate who meets the entry requirements specified in paragraph (1) shall be regarded as a bonafide candidate after —
(a) |
the candidate has completed and submitted the prescribed entry registration details;
|
(b) |
the candidate has paid the prescribed examination fees.
|
|
(4) |
Institutional candidates shall be registered by the head of the institution.
|
(5) |
A private candidate shall be registered through the County Director of Education.
|
(6) |
The head of an institution shall submit the registration data authenticated by every candidate together with other relevant registration documents not later than two weeks after the end of the registration period.
|
(7) |
The examination registration documents shall be submitted to the Council through the relevant County Director of Education.
|
(8) |
The head of an institution shall adhere to the registration deadlines prescribed by the Council for the relevant examinations.
|
(9) |
The County Director of Education shall be required to maintain a register of all the institutions submitting candidates for every Council examination.
|
|
10. |
Registration of Candidates by the Council
(1) |
A candidate who meets the entry requirements specified in Rule 8 shall be registered by the Council.
|
(2) |
Registration shall be based on an approved curriculum from the accredited authority.
|
(3) |
A new curriculum shall be examined not less than one year from the date the curriculum is received and approval by the Council.
|
|
11. |
Verification of candidate registration data
(1) |
The Council shall record the details regarding a candidate as given by the head of institution and the candidate in the process of registering for the examinations
|
(2) |
The head of an institution and the candidate shall ensure that all records appearing on a candidate's registration data are accurate.
|
(3) |
Where the candidate is below the age of eighteen years, the responsibility of verification of registration data shall be extended to the parent or guardian of the candidate.
|
|
12. |
Responsibility of a candidate
(1) |
A candidate shall ensure that entries including names, centre details, gender and subject or course combination are correct before signing the registration document.
|
(3) |
A candidate shall ensure that the candidate's name matches the name that appears on the candidate's birth certificate, deed poll or other certificates awarded by the Council in previous examinations.
|
(4) |
A candidate shall present oneself at the right time and institution for registration in the manner prescribed by the Council.
|
(5) |
A candidate shall take all examination papers registered for at the examination center the candidate registered or as directed by the Council.
|
(6) |
A candidate shall collect their result slip, certificate or diploma after release within the time prescribed by the Council.
|
|
13. |
Responsibility of a head of institution
(1) |
The head of an institution shall ensure that the entries of every candidate including names, centre details, gender and subject or course combinations are correct before signing the registration document.
|
(4) |
The candidate and the head of institution shall jointly and severally verify the data under paragraph 10 in the prescribed form.
|
(5) |
A head of institution who fails to register qualified candidates within the prescribed time commits an offence and shall be liable upon conviction to imprisonment for a term not exceeding one year or a fine not exceeding five hundred thousand shillings or to both.
|
(6) |
Where a candidate is less than eighteen years old, the responsibility for verification shall be extended to the parent or guardian.
|
|
14. |
Feedback mechanism
(1) |
Council shall provide for a feedback mechanism where a candidate, institution or any other interested stakeholder may confirm the accuracy of the registration data.
|
(2) |
The Council shall provide a mechanism for a head of institution to print and authenticate a candidates registration details.
|
|
15. |
Equation
(1) |
A person with a certificate from a recognised foreign examination body may seek equation under the relevant Rules before registering for the relevant examination offered by the Council.
|
(2) |
A person may be registered as a candidate after presenting a letter of equation issued by the Council for the relevant examination.
|
|
PART III – EXAMINATION PROCESS
16. |
Examination Fees
(1) |
The Council shall determine and communicate examination fees payable for each examination offered by the Council.
|
(2) |
An institutional candidate shall receive communication through the candidate's respective head of institution.
|
(3) |
A private candidate shall receive communication through the media or theoffices of the County Director of Education.
|
(4) |
A candidate is only deemed to have been registered after payment of the prescribed examination fees and after meeting the entry requirements.
|
(5) |
A candidate registered for a foreign examination administered by the Council on behalf of a foreign body shall pay the required examination fees to the foreign body or to the Council.
|
|
17. |
Transfer of Candidates
(1) |
A candidate registered under a particular institution or examination centre shall be required to take the examination at that centre or as directed by the Council.
|
(2) |
A candidate may transfer from one centre to another with the authority of the Council for reasons accepted as adequate and upon the payment of such transfer fees as may be determined by the Council.
|
(3) |
A request for a transfer under this Rule shall be consented to by both the releasing head of institution and the receiving head of institution through their respective County Director of Education
|
(4) |
An application for a transfer shall be received by the Council for consideration and approval at least five months before the commencement of the examination.
|
|
18. |
Withdrawal from Examination
(1) |
Where a candidate wishes to withdraw from an examination, the candidate shall send a notice of withdrawal to the Council through the respective head of institution and the respective County Director of Education.
|
(2) |
The notice of withdrawal shall be sent to the Council by the candidate at least later than sixty days from the date of start of the examination.
|
|
19. |
Award of Certificates and Diplomas
The Council shall issue a certificate to a candidate who meets the requirements for the award of a certificate or diploma in the manner specified in the guidelines for the respective course.
|
20. |
Issuing of examination results slips and certificates
(1) |
The Council shall issue examination results to a candidate after the marking of examination and processing of candidates marks.
|
(2) |
The final results shall be in numerical and or alphabetical grades.
|
(3) |
Provisional result slips shall be issued to individual candidates after the release of the respective examinations results.
|
(4) |
A certificate or diploma shall be issued to a candidate within a year from the date of release of examination results.
|
(5) |
The Council may correct the information given in the results slip before a certificate is issued where the Council finds that such a correction necessary.
|
(6) |
A certificate or diploma awarded to a candidate shall have—
(a) |
the examination taken by the candidate;
|
(b) |
the name of the candidate;
|
(c) |
the gender of the candidate;
|
(d) |
the index number of the candidate;
|
(e) |
the name of institution, for an institutional candidate;
|
(f) |
all subjects taken by the candidate in the examination and the level of attainment in every subject;
|
(g) |
the aggregate level of attainment;
|
(h) |
a photograph of the candidate where applicable;
|
(i) |
year and series of the examination; and
|
(j) |
any other feature that may be determined by the Council from time to time.
|
|
(7) |
The details of a certificate shall not be changed unless the amendment is to correct an error.
|
|
21. |
Examination Arrangements for Persons with Disabilities
(1) |
The Council may prepare a modified examinations paper for a candidate with special needs.
|
(2) |
The modification shall be based on an appropriate curriculum adopted by the Kenya Institute of Curriculum Development or any other accredited curriculum agency.
|
(3) |
Prospective candidates and head of relevant institution shall provide such information in prescribed forms at registration.
|
(4) |
The County Director of Education shall submit to the Council, at the time of registration for examination the—
(d) |
nature of impairment; and
|
(e) |
degree of impairment of the candidate with special needs.
|
|
(5) |
The duration of examination allowed for a candidate with special needs may be varied by the Council depending on the candidate's degree of impairment.
|
(6) |
The degree of impairment shall be supported by evidence from a qualified professional assessor.
|
|
22. |
Examination Timetable
(1) |
The Council shall provide a provisional examination timetable to relevant institutions and stakeholders in advance for feedback.
|
(2) |
The Council shall provide the final examination timetable to all the heads of institutions and candidates.
|
(3) |
The time allowed for answering questions in every examination paper shall be indicated on the timetable and shall also appear on the rubric of the question paper.
|
(4) |
Where the time indicated in the timetable differs from that printed on the examination question paper, the time in the rubic of the question paper shall prevail.
|
|
23. |
Materials and Equipment for Examinations
(1) |
Any institution presenting a candidate for examination shall be required by the Council to provide the facilities, materials and equipment required for the examination.
|
(2) |
All scripts, projects and other materials submitted to the Council for any examination, whether written or practical, shall be the property of the Council.
|
(3) |
The Council shall not accept responsibility for the loss of or damage to any script, project or coursework materials before such is received by the Council for marking.
|
(4) |
The Council's Mathematical Tables shall be the only mathematical tables allowed in the examination room for use in answering questions unless the instructions on the question paper rubric states otherwise.
|
(5) |
A silent, cordless and non-programmable calculator may be used in answering questions unless specifically forbidden in the rubric of the question paper and Council regulations.
|
|
24. |
Language of Examination
All answers to an examination questions shall be written in the English language except for language subjects other than English, or as otherwise specified in the rubric of the question paper.
|
25. |
Candidates with Medical Conditions
(1) |
A candidate who has been diagnosed by a trained medical professional and has been put on quarantine shall take the examination at a separate examination room provided that the Council receives information from the head of institution through the County Director of Education.
|
(2) |
The Council shall endeavour to quarantine candidates with different medical conditions in separate rooms.
|

These Rules may be cited as the Kenya National Examinations Council (Handling of Examination Irregularities) Rules.

2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act (Cap. 214A);
"examination centre" means an institution or premises approved and registered by the Council for purposes of administration of a Council examination;
"examination irregularities/examination malpractices" means any action which contravenes the set rules and regulations for the conduct of examinations;
"examination room" means a classroom or a hall within an examination centre that has been designated for candidates to sit a Council examination and includes any other area that a candidate has access to during the examination;
"head teacher" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"Principal" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"post school examination" includes Business, Technical and Teacher Education Examinations administered by the Council;
"stimulus materials" means any unauthorised material including visual aids, diagrams, charts and apparatus that contain any content of any subject that may be found in an examination room or centre;
"unauthorized material" means any information or materials that a candidate is found with within an examination room or centre which a candidate is not allowed to have access to during the examination period;
"widespread examination irregularities" means casein instance where all the candidates in an examination centre are proven to have been involved in examination irregularities;
"year of examination" means the calendar year in which a particular Council examination is administered.

3. |
Examination irregularity and misconduct
(1) |
The Council shall prepare and circulate to candidates and examination officials, regulations governing the conduct of Council examinations.
|
(2) |
The Council shall take appropriate action against any candidate, person or any examination centre that is involved in an examination irregularity or malpractice.
|
|
4. |
The role of Principals and head teachers
(1) |
The principal or head teacher of an institution shall establish mechanisms to deter the commission of examination irregularities and malpractises.
|
(2) |
Any principal or head teacher who encounters any examination irregularity or malpractice shall take such action as is provided under the Act or any other written law, these Rules and Council Examination Regulations and report the matter to the Council.
|
(3) |
Any principal or head teacher who aids, abets, induces or acts in a manner that condones commission of examination irregularity or malpractice commits an offence.
|
|
5. |
Reports
(1) |
An authorized agent, supervisor, invigilator or Council officer monitoring the conduct of an examination shall make a written report on any examination irregularity—
(b) |
at an examination centre; or
|
(c) |
at any other place which comes to his or her attention.
|
|
(2) |
Any person who witnesses an examination irregularity shall report to the Council, an education officer or to the police.
|
(3) |
The Council may, before making a decision on any report received, subject the report to investigations.
|
(4) |
An examiner who notices an irregularity during the marking of an examination shall compile and submit a report to the Council.
|
|
6. |
Search and confiscation of unauthorized materials
(1) |
An officer of the Council, a security officer or any Council agent may conduct a search on a candidate, examination centre, or premises used for examination related purposes, if they have reason to believe that an examination irregularity may be taking place or has taken place.
|
(2) |
The head of an institution, supervisor, invigilator, security officer, a council agent or a Council officer shall confiscate any unauthorized material found in the possession of a candidate or any other person or within any examination centre or premise.
|
(3) |
A supervisor, invigilator, security officer, Council officer or any Council agent who confiscates unauthorized material under paragraph (2) shall keep such unauthorized materials confiscated as evidence of the irregularity.
|
(4) |
Any unauthorized material confiscated under paragraph (2) shall be forwarded to the Council and may be used as evidence of an examination irregularity.
|
(5) |
A person found with unauthorized examination materials may be forwarded to the police for investigations and prosecution in accordance to the Act and any other written law.
|
(6) |
Where confiscated materials are handed to the police for purpose of investigation and prosecution, the Council shall keep a record of all confiscated materials for purpose of accountability.
|
|
7. |
Investigations
(1) |
The Council shall conduct investigations into the reports on the alleged examination irregularity.
|
(2) |
The Council may use a candidate or candidate's school records to conduct investigations and make a decision.
|
(3) |
A report of the findings shall be prepared on any investigations carried out.
|
|
8. |
Withholding of results
The Council may withhold examination results for any candidate or examination centre suspected of having been involved in an examination irregularity or malpractice pending completion of investigations or disciplinary action or any other appropriate action.
|
9. |
Penalties
Where the Council is satisfied that a candidate has been involved in an examination irregularity or malpractice the Council may—
(a) |
expel the candidate from the examination, the examination room or centre;
|
(b) |
cancel any of the candidate's examination papers already done;
|
(c) |
cancel any of the candidate's results;
|
(d) |
deny the candidate entry into any subsequent examinations;
|
(e) |
report the matter to the police with a view of having the candidate investigated and charged for the offence; or
|
(f) |
take any other action that the Council may consider appropriate under the Act or any other written law.
|
|
10. |
Examination centre
(1) |
Where the Council is satisfied that—
(a) |
there has been widespread examination irregularities at an examination centre; or
|
(b) |
the circumstances in which an examination is conducted at an examination centre are unsatisfactory, the Council may cancel the entire examination conducted at the examination centre or any one or more papers or the results thereof in relation to all the candidates at the examination centre.
|
|
(2) |
The Council may, where the entire results are cancelled under paragraph (1), deregister an examination centre whose examination results may have been cancelled.
|
|
11. |
Notification of withheld or cancelled results
(1) |
A candidate or an examination centre whose, results are withheld or cancelled shall as soon as the results have been announced be informed, in writing, of the Council's decision through the respective County Director of Education or through any other means as the Council may determine from time to time.
|
(2) |
A candidate whose results are cancelled shall receive a result designated as "Y" in the subject cancelled and an overall result designated as "Y".
|
(3) |
A candidate who receives a result designated as "Y" shall not be awarded a certificate or diploma.
|
(4) |
Notwithstanding paragraph (2), a candidate in the Kenya Certificate of Primary Education examination shall receive a result of zero in the subject cancelled.
|
(5) |
Where a Kenya Certificate of Primary Education examination candidate is proved to have cheated in three or more subjects the candidate shall have an overall result of zero.
|
(6) |
A Kenya Certificate of Primary Education examination candidate with an overall result of zero shall not be awarded a certificate in that examination.
|
(7) |
The Council may in any subsequent registration recognize a Kenya Certificate of Primary Education candidate with a result of zero in any one or two subjects for purposes of registration.
|
|
12. |
Barring of candidates
A candidate whose examination results are cancelled may be prohibited from taking any Council's examination for three consecutive years.
|
13. |
Council management
(1) |
The Council's management shall, upon receiving report of examination irregularity in any examination, cause a report to be compiled and discussed by the management of the Council.
|
(2) |
The management of the Council shall submit the report on irregularity to the Examinations Management Committee.
|
|
14. |
Decision of the Examinations Management Committee
(1) |
Where the Examinations Management Committee is satisfied that the report presents satisfactory evidence of an examination irregularity, the results for the affected candidate shall be cancelled.
|
(2) |
A candidate whose results have been cancelled shall be informed in writing indicating the examination irregularity.
|
|
15. |
Review of cancelled examination results
(1) |
A candidate whose examination results have been cancelled may apply to the Council within thirty days after release of the results for a review of the Council's decision.
|
(2) |
An application for a review of cancelled results shall be made in writing and shall indicate clearly the grounds for requesting the review.
|
(3) |
The Council shall upon receiving an application, consider the application and respond, in writing, to the applicant within thirty days.
|
(4) |
Where the Council declines an application for review, the Council shall specify the reasons for declining the application for review of cancelled results.
|
|
16. |
Hearing of the application for review
Where the Council considers that the grounds raised by the applicant warrant a review, the Council shall—
(a) |
communicate the decision in writing to the applicant; and
|
(b) |
may require the applicant to appear for a hearing of the application within ninety days of receipt of the council's communication.
|
(c) |
Where the Council is satisfied that the candidate has not been involved in any examination irregularity, the Council shall release the results to the candidate.
|

17. |
Cancelled results
Any examination results cancelled by the Council under these Rules shall not be re- assessed.

THE KENYA NATIONAL EXAMINATIONS COUNCIL (MARKING OF EXAMINATIONS, RELEASE OF RESULTS AND CERTIFICATION) RULES
1. |
Citation
These Regulations may be cited as the Kenya National Examinations Council (Marking of Examinations, Release of Results and Certification) Rules, 2015.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"centre organizer" means a principal or head teacher appointed by the Council to be in charge of the administration of the marking exercise in an institution where a Council examination is being marked;
"chief examiner" means an examiner contracted by the Council to be the overall in charge of the marking exercise of a particular examination paper or papers and is to ensure that marking of candidate scripts is carried out in accordance with these Regulations;
"deputy chief examiner" means a Kenya Certificate of Primary Education examiner responsible to the Chief Examiner and coordinates Assistant Chief Examiners in the entire process of marking of Kenya Certificate of Primary Education Examinations at a particular marking centre
"assistant chief examiner" means an examiner responsible to the Deputy Chief Examiner and coordinates Team Leaders in the marking of Kenya Certificate of Primary Education examination;
"co-ordination of marking" means the process of coaching examiners of a particular Council examination paper to ensure that they are able to mark the paper in a uniform way and in accordance with these Regulations;
"examiner" means a qualified teacher or specialist who has been trained and commissioned by the Council to assess or mark a candidate's script in a particular course or examination paper;
"dummy" means a model candidate script used to coordinate the marking exercise;
"examination marking regulations" means a set of regulations used to govern the process of marking Council examinations;
"head of institution" means the head of a school or an academic institution and includes director or manager administrator of an institution;
"marking centre" means a venue approved by the Council to host the marking of a Council examination;
"mark-sheet" means a form used to record the marks of a candidate for a particular examination paper;
"result slip" means a document issued by the Council showing provisional examination results attained by a candidate in an examination;
"team leader" means an examiner in charge of a team of several examiners marking a particular Council examination paper or papers;
"query" means an enquiry or complaint by a candidate, parent, invigilator, supervisor, examiner or any other stakeholder on Council's activities.

PART II – MARKING OF EXAMINATIONS
3. |
Marking of examinations
(1) |
The marking of any Council examination shall be carried out in an institution which has been approved by the Council as a marking centre.
|
(2) |
The Council shall set out a criterion for approval of marking centres.
|
(3) |
The Council may use its registered offices as a marking centre.
|
(4) |
The Council shall appoint examiners to mark Council examinations.
|
|
4. |
Registration and approval of a marking centre
(1) |
The Council may register an institution or any venue that qualifies as a marking centre.
|
(2) |
A venue or institution other than the offices of the Council shall qualify for registration as a marking center if the venue—
(a) |
has been considered a Marking Centre through an application to the administration;
|
(b) |
has adequate accommodation, provides hot water and clean sanitary facilities that provide privacy;
|
(c) |
has clean dining facilities with sufficient cutlery and adequate sitting capacity for a minimum of five hundred persons;
|
(d) |
has adequate working rooms that are well lit (with natural light and electricity), ventilated with burglar proof windows and doors;
|
(e) |
has a secured computer laboratory with not less than twenty modern model functional computers protected with up-to date anti-virus software, power back up as well as Uninterrupted Power Supply (UPS) and interne connectivity, a laboratory with two functional printers of specifications determined by the Council from time to time;
|
(f) |
can secure twenty four hour armed security personnel;
|
(g) |
has recreational facilities;
|
(h) |
has a sanatorium with a qualified nurse and a hospital located nearby;
|
(i) |
can be easily accessible by public transport and communication facilities;
|
(j) |
can be connected to the national grid and have a stand by three phase generator; and
|
(k) |
has the centre organizer or the assistant centre organizer available within the marking centre throughout the marking period.
|
|
(3) |
The Council may review the criteria in paragraph (2) from time to time.
|
(4) |
The Council may deregister and or suspend an approved marking centre which fails to maintain the conditions set out in paragraph (2).
|
|
5. |
Foreign Certificates
Where the Council has approved an institution or venue as a marking centre, the centre organizer shall be expected to—
(a) |
ensure that the marking centre has adequate accommodation, catering, medical, recreational and ICT facilities;
|
(b) |
ensure adequate security to safeguard examination materials, personnel and equipment;
|
(c) |
provide a secure strong room for the storage of examination materials required for the marking exercise;
|
(d) |
monitor the marking exercise to ensure progress under the marking programme;
|
(e) |
appoint assistant centre organizers, temporary employees and assign such officials duties in the management of the marking exercise as specified by the Council; and
|
(f) |
perform other duties that may be assigned by the Council from time to time
|
|
6. |
Monitoring of the marking progress
A centre organizer shall liaise with the Council on the marking progress in every paper marked at the centre.
|
7. |
Categories of Examiners
(1) |
The Council shall have atleast three categories of examiners—
(a) |
chief examiner or examiner-in-charge;
|
(b) |
senior examiner (including assistant chief examiner, deputy chief examiner, and team leader; and
|
|
(2) |
The role of each category of examiners shall be as stipulated under rules 8-10.
|
|
8. |
Role of Chief Examiner or Examiner In- Charge and Deputy Chief Examiner
(1) |
A chief examiner or examiner-in-charge shall—
(a) |
report to the Council on all aspects of marking;
|
(b) |
take the overall leadership of the examination marking exercise for that paper or papers the chief examiner is in charge of;
|
(c) |
give the Council a cumulative record of the number of scripts marked every day by every examiner;
|
(d) |
give the Council information on the expected completion date of marking of every paper;
|
(e) |
ensure that administrative arrangements at the marking centre are made in accordance to the Council's guidelines and marking regulations;
|
(f) |
select scripts for coordination of marking in accordance with the Council's guidelines on selection of scripts;
|
(g) |
co-ordinate with senior examiners and other examiners before and during the actual marking to ensure that one marking standard is maintained throughout the marking exercise;
|
(h) |
ensure that the Council examination marking regulations are read, understood and adhered to by every examiner;
|
(i) |
ensure that examiners observe marking discipline, are actively engaged in the work allocated to them and are not indulging in any activity that may slow, disrupt or compromise the integrity of the marking exercise;
|
(j) |
prepare confidential reports on senior examiners;
|
(k) |
verify all payment claim forms completed by senior examiners;
|
(l) |
keep an accurate daily attendance register of all examiners marking the paper the chief examiner is in charge of;
|
(m) |
read through confidential reports of every examiner and make recommendations for promotions or reprimanding of examiners; and
|
(n) |
attend meetings to discuss marking programmes upon invitation by the Council.
|
|
(2) |
The Council may disqualify a chief examiner who fails to attend meetings to discuss marking programmes upon invitation by the Council.
|
|
9. |
Assistant Chief Examiners
(1) |
An assistant chief examiner shall be appointed by the Council and shall report to and be assigned duties by the chief examiner or deputy chief examiner.
|
(2) |
The assistant chief examiner shall—
(a) |
coordinate team leaders and the examiners in the marking of Kenya Certificate of Primary Education examinations;
|
(b) |
ensure that the marking regulations are complied with by the examiners under the team leader;
|
(c) |
prepare a confidential report to the chief examiner or examiner on the work of team leaders;
|
(d) |
verify the number of scripts marked by every team leader in their team;
|
(e) |
ensure that the set standard on the marking exercise are maintained; and
|
(f) |
advice the chief examiner or deputy chief examiner on standard as evidenced by the quality of the work of the relevant candidates in the report submitted by other examiners.
|
|
|
10. |
Duties of a team leader
A team leader shall report to the assistant chief examiner and shall have the following duties—
(a) |
participate in the coordination meeting with the relevant chief examiner;
|
(b) |
coordinate examiners in the team under the team leader prior to the marking of live scripts;
|
(c) |
prepare a confidential report on the work of examiners in the team;
|
(d) |
advise the assistant chief examiner on the standards as evidenced by the quality of the work of the relevant candidates in the reports submitted by other examiners;
|
(e) |
assist in any other marking operation assigned by the chief examiner or assistant chief examiner; and
|
(f) |
monitor the security of the marking exercise.
|
|
11. |
Role of an examiner
(1) |
An examiner shall work under the supervision of a senior examiner and shall perform the following duties—
(a) |
attend and participate in the pre-marking coordination meetings;
|
(b) |
mark live scripts according to the marking regulations and marking scheme;
|
(c) |
complete claim forms for scripts marked and submit the forms and scripts to the team leader before leaving the marking centre; and
|
(d) |
prepare preliminary reports on the work of the relevant candidates to be submitted to the team leader for study and necessary advice given to the chief examiner for incorporation into the main confidential report on the work of candidates.
|
|
(2) |
An examiner shall not take a candidate script out of the marking room for any reason whatsoever
|
|
12. |
Marking procedure
(1) |
The Council shall determine and document the procedures and regulations to be followed during marking of all Council examinations
|
(2) |
The Council may review the marking procedures and regulations from time to time.
|
|
PART III – TRAINING AND RECRUITMENT OF EXAMINERS
13. |
Training and recruitment
(1) |
The Council shall establish mechanisms to ensure that examiners are trained.
|
(2) |
The Council may enter into a Memorandum of Understanding with any recognized educational institution to train examiners.
|
|
14. |
Training of examiners
(1) |
(a) |
develop a curriculum for the training of examiners;
|
(b) |
ensure that all examiners are trained using the curriculum developed under paragraph(a);
|
(c) |
develop a criteria for assessment of examiner trainees; and
|
(d) |
award certificates to all successful trainees after training.
|
|
(2) |
The Council may under special circumstances conduct on the job training of examiners for particular papers or courses.
|
(3) |
The Council may review the curriculum for training of examiners from time to time.
|
(4) |
The Council may advertise through the media or other means on training of examiners.
|
|
15. |
Short-listing of examiners
(1) |
The Council shall be guided by the following criteria when short-listing examiner trainees—
(a) |
be a practicing teacher and trainer in the relevant subject areas;
|
(b) |
have a minimum teaching experience of at least three years after graduation;
|
(c) |
be a person of integrity as specified in chapter six of the Constitution of Kenya; and
|
(d) |
has attained academic or professional qualifications specified by the Council.
|
|
(2) |
The qualifications under paragraph (1) (d) shall be—
(a) |
at least P 1 for examiners in the Kenya Certificate of Primary Education and a minimum grade of a C at the Kenya Certificate of Secondary Education examination level or equivalent in the subject or paper applied for;
|
(b) |
at least a diploma for Kenya Certificate Secondary Education, post school and teacher education; and
|
(c) |
be recommended for training by the relevant head of institution.
|
|
(3) |
On completion of training, the successful trainee shall be included in the Council's data base for trained examiners.
|
|
16. |
Criteria for appointment of examiners
(1) |
The Council shall develop standards or criteria for appointment of Examiners.
|
(2) |
An examiner who does not meet these set standards or criteria for marking shall be informed in writing.
|
(3) |
(a) |
be successfully trained as an examiner and be in the Council's database;
|
(b) |
be willing to mark under the Council's marking procedures, regulations and terms and conditions of service;
|
(c) |
be willing and able to keep the marking programme and set marking targets;
|
(d) |
sign and keep the oath of secrecy;
|
(e) |
keep their identity and any information acquired during the marking process confidential;
|
(f) |
refrain from indulging in behaviour likely to disrupt the smooth running of the marking exercise; and
|
(g) |
declare any interest before the start of marking.
|
|
(4) |
An appointment to mark answer scripts shall be made by the Council and such appointment shall cover only one series.
|
(5) |
Once appointed for a particular series, an examiner shall not be required to reapply for subsequent series but shall inform the Council of any changes in particulars.
|
(6) |
The Council shall sign a marking contract stipulating terms and conditions of engagement with each examiner.
|
(7) |
The Council shall reserve the right to terminate the services of an examiner for breach of these rules and any regulations made by the Council relating to the marking of examinations.
|
(8) |
An examiner who does not participate in a marking exercise for two consecutive sessions shall be removed from the Council's examiners data base without reference to the examiner
|
(9) |
An examiner shall account for Council and marking centre property issued to the examiner before leaving the marking centre.
|
|
17. |
Co-ordination of Examiners
The chief examiner will coordinate the question paper and marking scheme to ensure the accuracy of examination.
|
18. |
Marking of examinations
(1) |
The Council shall develop regulations for marking all examinations.
|
(2) |
Examiners shall use the set criteria to mark all examinations.
|
(3) |
After marking a candidate's script, the examiner shall tally all marks attained by the candidate in the examination paper being marked.
|
(4) |
A candidate's script and marks shall not be taken out of a marking center by an examiner or an official at the marking centre.
|
(5) |
An examiner, a center organizer or an official at the marking center shall not photocopy or transfer a candidate's work or marks in whatever form other than the one prescribed by the Council.
|
(6) |
The marking scheme and marking regulations shall not be taken out of the marking centre by any examiner, or a centre organizer or officials at the marking center.
|
(7) |
Notwithstanding paragraph 4 and 6, the center organizer shall return all the candidate scripts and all marking materials to the Council after the completion of marking.
|
|
19. |
Restriction to access of marked scripts
An examination script shall not be accessible to any candidate, institution, teacher or any other third party representing the interest of the candidate once the script has been marked.
|
PART IV – PROCESSING AND ISSUE OF EXAMINATION RESULTS
20. |
Processing of marks and release of examination results
(1) |
The Council shall record and process candidate marks into examination results.
|
(2) |
The Examination results under paragraph (1) shall be released and announced by the Council.
|
(3) |
Examination results released by the Council under paragraph (2) shall be the official results of the Council.
|
|
21. |
Contracted professionals
(1) |
The Council may engage such educationist and other professionals as shall be determined by the Council in the processing of examination results.
|
(2) |
A contracted professional engaged in the processing of examination results shall maintain integrity, declare his or her interest and subscribe to an oath of secrecy.
|
|
22. |
Responsibility of heads of institutions
(1) |
A head of an institution shall be responsible for submitting all examination marks regarding the relevant candidate's continuous assessment test, course work, project and teaching practice in accordance with the deadline set by the Council.
|
(2) |
Where a head of institution or relevant person fails to comply with sub-rule (1) the candidate shall not be awarded a Certificate or Diploma.
|
|
23. |
Issuance of result slips
(1) |
The Council shall issue result slips to successful candidates upon completion of marking, processing and release of examination results..
|
(2) |
The personal details recorded on an examination result slip shall be those provided by the candidate during registration and the grades attained in the examination.
|
(3) |
The results indicated in a candidate's result slip shall be provisional.
|
|
24. |
Issuance of Certificates
The Council shall issue certificates and diplomas to qualified candidates within twelve months of the release of examination results.
|
25. |
Withdrawal of results or certificates
The Council may withdraw an examination result, a certificate or diploma where the Council is satisfied that—
(a) |
the result, certificate and or diploma was issued and or acquired in a fraudulent manner;
|
(b) |
an examination irregularity was committed before or during the time the candidate sat the examination or before release of the examination results; or
|
(c) |
the candidate sat the examination without fulfilling the minimum examination entry requirement.
|
|
26. |
Handling of examination queries
(1) |
A person may lodge a query to the Council on—
(a) |
a candidate's personal details; or
|
|
(2) |
In resolving queries lodged under paragraph (1), the Council shall be guided by, the Act, these Rules, written laws, Council policies, Council procedures and Council regulations
|
(3) |
An applicant submitting any query to the Council for resolution shall ensure the applicant provides all the required evidence to enable the Council process and validate the query promptly.
|
|
27. |
Review of examination results
(1) |
A candidate may apply to the Council for review of the decision in respect to the candidate's examination results or data under the Act, these Rules or any other written law.
|
(2) |
A review under paragraph (1) shall be lodged to the Council by the candidate within thirty days from the date of release of the examination results
|
(3) |
An application for review under paragraph (2) shall be made to the Council in writing.
|
(4) |
The Council shall upon receiving an application for review, consider the application and make a decision.
|
(5) |
In determining an application for review, the Council may—
(b) |
approve part of the request; or
|
|
(6) |
A decision made in response to the review shall be in writing and shall be communicated to the applicant within ninety days from the date of receipt of the application.
|
(7) |
The decision of a review under these Rules shall be final.
|
|
28. |
Conditions for Change of certificates
(1) |
A candidate shall be required to return an original certificate, diploma or result slip initially issued to the candidate by the Council in case any change has been effected by the Council on the results slip, certificate or diploma.
|
(2) |
A candidate shall return such a certificate before the corrected result slip, certificate or diploma can be issued to the candidate.
|
|
THE KENYA NATIONAL EXAMINATIONS COUNCIL (MANAGEMENT OF EXAMINATION) RULES
1. |
Citation
These Rules may be cited as the Kenya National Examinations Council (Management of Examination) Rules.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"Act" means the Kenya National Examinations Council Act (Cap. 214A);
"attendance sheet" means an authentic record for all candidates that have sat a particular Council examination;
"County Director of Education" has the meaning assigned to it under the Basic Education Act (Cap. 211);
"distribution centre" means a secure and safe storage facility outside the Council premises approved by the Council for the storage of examination materials;
"examination centre" means an institution or premises approved and registered by the Council for purposes of administering Council examinations;
"examination period" means and includes the time when the means and includes the time when the council is in the process of printing, packing, distributing, administering, marking and processing any examination administered by the Council;
"examination results" means the overall outcome of the grades attained by a candidate and released by the Council after a candidate has sat for an examination conducted by the Council;
"examination room" means that space, compound, premises, area within which a Council examination is being administered;
"headteacher" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"institutional candidate" means a candidate registered for an examination the Council through an institution of learning;
"post school examination" includes but is not limited to Business, Technical and Teacher Education Examinations administered by the Council;
"pre-registration" means advance compilation of data for candidates who will sit for the Kenya Certificate of Primary Education and Kenya Certificate of Secondary examinations;
"principal" has the meaning assigned to it under the Teachers Service Commission Act (Cap. 212);
"private candidate" means a candidate who is registered to sit an examination at a private centre;
"private centre" means an institution or premises which is approved and registered by the Council as a private examination centre for purposes of examination administration;
"registration period" means period prescribed for candidates registration for each examination offered by the Council;
"result slip" means a document issued by the Council showing the provisional examination results obtained by a candidate in an examination;
"rubric" means the rules or instructions on the cover page of an examination question paper and the answer scripts;
"year of examination" means the calendar year in which a particular Council examination is administered.

PART II – REGISTRATION
3. |
Distribution Centre
(1) |
The Council shall approve distribution centres for the purpose of storing examination materials.
|
(2) |
Council examination materials shall only be stored in Council approved distribution centres.
|
(3) |
Distribution centres shall be approved at least one year before they are used.
|
|
4. |
Approval of a distribution centre
The Council shall approve a distribution centre which
(a) |
is a permanent structure;
|
(b) |
has burglar proof doors and windows;
|
(c) |
has secure storage facilities;
|
(d) |
has sufficient security officers;
|
(f) |
has capacity to store examination materials for examination centres to be served;
|
(g) |
is located in a conducive environment; and
|
(h) |
meets any other criteria that the Council may determine from time to time.
|
|
5. |
Distribution center
Notwithstanding paragraph (1), the Council may approve a distribution center subject to such conditions for use of such a distribution center as the Council may specify.
|
6. |
Opening of new distribution centres
(1) |
The County Director of Education shall recommend the opening of a new distribution centre for approval by the Council where the distance between a distribution centre and an examination centre is more than fifty kilometers.
|
(2) |
Notwithstanding paragraph (1), the Council may approve a new distribution center in areas of high candidature or areas that have been identified by the Council to be in need of a distribution center even when the distances are less than fifty kilometers.
|
|
7. |
Examination Centres
(1) |
The Council shall determine the minimum facilities required for registration of an examination center.
|
(2) |
The Council shall establish the criteria for inspection of an examination center.
|
(3) |
The Council may review the minimum facilities and criteria required for an examination center.
|
(4) |
A Council examination shall only be administered at an examination centre approved and registered by the Council.
|
(5) |
The Council may delegate the role of approval of examination centers to the County Directors of Education.
|
(6) |
An institution registered by the Ministry in-charge of Education that wishes to offer a Council examination for the first time, shall apply to the Council for registration as an examination centre at least one year before the year of examination.
|
(7) |
The application shall be sent to the Council through the respective County Director of Education.
|
(8) |
An application under paragraph (6) and (7) shall be accompanied by a valid registration certificate and an inspection report issued by the Ministry in-charge of Education through the County Director of Education.
|
(9) |
The Council may cause a centre to be inspected before it is approved and registered as an examination centre.
|
(10) |
Where the Council has received all relevant documents, supporting evidence and is satisfied that the application meets the minimum requirements for an examination centre, the Council shall approve, register and issue the centre with an examination centre code.
|
(11) |
An examination centre shall be required to have the required facilities, equipment and materials for administration of the relevant examination and be located in an environment conducive for the administration of examinations.
|
(12) |
The Council shall reserve the right to deregister or cancel the registration of an examination centre.
|
(13) |
The Council may suspend or deregister an approved examination centre—
(a) |
where the Council is satisfied that the centre does not comply with the Act, these Rules and or the Council's examination regulations; or
|
(b) |
where the continuation of the institution as an examination centre would endanger the security of examinations.
|
|
(14) |
The Council may merge examination centres for purposes of ease of administration of examinations and for security reasons.
|
(15) |
The Council may administer foreign examinations on behalf of a foreign examination body.
|
(16) |
The foreign examination administered under paragraph (15) shall be at an examination centre approved by the relevant foreign examination body and by the Council.
|
|
8. |
Minimum number of candidates
(1) |
An examination centre shall register a minimum of—
(a) |
fifteen candidates for school examination; and
|
(b) |
ten candidates for post school examinations.
|
|
(2) |
Any examination centre which registers less than the number of candidates stipulated in paragraph (1) and wishes to remain as an examination centre shall pay the cost of registering the minimum number of candidates required.
|
(3) |
The Council may review the minimum number of candidates for every examination centre from time to time.
|
|
9. |
Entry requirements
(1) |
(a) |
the Council shall specify the entry requirements for every examination offered by the Council;
|
(b) |
the Council may carry out pre-registration for Kenya Certificate of Primary Education and Kenya Certificate of Secondary Education examinations;
|
(c) |
the Council shall determine the time to carry out pre-registration.
|
(d) |
the Council may use the pre-registration data to confirm registration details of a candidate;
|
(e) |
a person that did not register during pre-registration, may be registered by the Council under such conditions to be determined by the Council;
|
(f) |
where a person does not register at the time of pre-registration, the person may be required to pay a penalty for registration;
|
(g) |
a penalty under paragraph (1)(f) shall be determined by the Council from time to time.
|
(h) |
Any person who uses undue influence or threats to register a candidate in an institution where the candidate has not been studying shall be guilty of an offence and shall be liable upon conviction to imprisonment for a term not exceeding six months or a fine not exceeding one hundred thousand shillings or both.
|
|
(2) |
A candidate who intends to sit for examinations shall fulfill all the entry requirements set by the Council for the relevant examination.
|
(3) |
A candidate who meets the entry requirements specified in paragraph (1) shall be regarded as a bonafide candidate after —
(a) |
the candidate has completed and submitted the prescribed entry registration details;
|
(b) |
the candidate has paid the prescribed examination fees.
|
|
(4) |
Institutional candidates shall be registered by the head of the institution.
|
(5) |
A private candidate shall be registered through the County Director of Education.
|
(6) |
The head of an institution shall submit the registration data authenticated by every candidate together with other relevant registration documents not later than two weeks after the end of the registration period.
|
(7) |
The examination registration documents shall be submitted to the Council through the relevant County Director of Education.
|
(8) |
The head of an institution shall adhere to the registration deadlines prescribed by the Council for the relevant examinations.
|
(9) |
The County Director of Education shall be required to maintain a register of all the institutions submitting candidates for every Council examination.
|
|
10. |
Registration of Candidates by the Council
(1) |
A candidate who meets the entry requirements specified in Rule 8 shall be registered by the Council.
|
(2) |
Registration shall be based on an approved curriculum from the accredited authority.
|
(3) |
A new curriculum shall be examined not less than one year from the date the curriculum is received and approval by the Council.
|
|
11. |
Verification of candidate registration data
(1) |
The Council shall record the details regarding a candidate as given by the head of institution and the candidate in the process of registering for the examinations
|
(2) |
The head of an institution and the candidate shall ensure that all records appearing on a candidate's registration data are accurate.
|
(3) |
Where the candidate is below the age of eighteen years, the responsibility of verification of registration data shall be extended to the parent or guardian of the candidate.
|
|
12. |
Responsibility of a candidate
(1) |
A candidate shall ensure that entries including names, centre details, gender and subject or course combination are correct before signing the registration document.
|
(2) |
A candidate shall ensure that the candidate's name matches the name that appears on the candidate's birth certificate, deed poll or other certificates awarded by the Council in previous examinations.
|
(3) |
A candidate shall present oneself at the right time and institution for registration in the manner prescribed by the Council.
|
(4) |
A candidate shall take all examination papers registered for at the examination center the candidate registered or as directed by the Council.
|
(5) |
A candidate shall collect their result slip, certificate or diploma after release within the time prescribed by the Council.
|
|
13. |
Responsibility of a head of institution
(1) |
The head of an institution shall ensure that the entries of every candidate including names, centre details, gender and subject or course combinations are correct before signing the registration document.
|
(2) |
The candidate and the head of institution shall jointly and severally verify the data under paragraph 10 in the prescribed form.
|
(3) |
A head of institution who fails to register qualified candidates within the prescribed time commits an offence and shall be liable upon conviction to imprisonment for a term not exceeding one year or a fine not exceeding five hundred thousand shillings or to both.
|
(4) |
Where a candidate is less than eighteen years old, the responsibility for verification shall be extended to the parent or guardian.
|
|
14. |
Feedback mechanism
(1) |
Council shall provide for a feedback mechanism where a candidate, institution or any other interested stakeholder may confirm the accuracy of the registration data.
|
(2) |
The Council shall provide a mechanism for a head of institution to print and authenticate a candidates registration details.
|
|
15. |
Equation
(1) |
A person with a certificate from a recognised foreign examination body may seek equation under the relevant Rules before registering for the relevant examination offered by the Council.
|
(2) |
A person may be registered as a candidate after presenting a letter of equation issued by the Council for the relevant examination.
|
|
PART III – EXAMINATION PROCESS
16. |
Examination Fees
(1) |
The Council shall determine and communicate examination fees payable for each examination offered by the Council.
|
(2) |
An institutional candidate shall receive communication through the candidate's respective head of institution.
|
(3) |
A private candidate shall receive communication through the media or theoffices of the County Director of Education.
|
(4) |
A candidate is only deemed to have been registered after payment of the prescribed examination fees and after meeting the entry requirements.
|
(5) |
A candidate registered for a foreign examination administered by the Council on behalf of a foreign body shall pay the required examination fees to the foreign body or to the Council.
|
|
17. |
Transfer of Candidates
(1) |
A candidate registered under a particular institution or examination centre shall be required to take the examination at that centre or as directed by the Council.
|
(2) |
A candidate may transfer from one centre to another with the authority of the Council for reasons accepted as adequate and upon the payment of such transfer fees as may be determined by the Council.
|
(3) |
A request for a transfer under this Rule shall be consented to by both the releasing head of institution and the receiving head of institution through their respective County Director of Education
|
(4) |
An application for a transfer shall be received by the Council for consideration and approval at least five months before the commencement of the examination.
|
|
18. |
Withdrawal from Examination
(1) |
Where a candidate wishes to withdraw from an examination, the candidate shall send a notice of withdrawal to the Council through the respective head of institution and the respective County Director of Education.
|
(2) |
The notice of withdrawal shall be sent to the Council by the candidate at least later than sixty days from the date of start of the examination.
|
|
19. |
Award of Certificates and Diplomas
The Council shall issue a certificate to a candidate who meets the requirements for the award of a certificate or diploma in the manner specified in the guidelines for the respective course.
|
20. |
Issuing of examination results slips and certificates
(1) |
The Council shall issue examination results to a candidate after the marking of examination and processing of candidates marks.
|
(2) |
The final results shall be in numerical and or alphabetical grades.
|
(3) |
Provisional result slips shall be issued to individual candidates after the release of the respective examinations results.
|
(4) |
A certificate or diploma shall be issued to a candidate within a year from the date of release of examination results.
|
(5) |
The Council may correct the information given in the results slip before a certificate is issued where the Council finds that such a correction necessary.
|
(6) |
A certificate or diploma awarded to a candidate shall have—
(a) |
the examination taken by the candidate;
|
(b) |
the name of the candidate;
|
(c) |
the gender of the candidate;
|
(d) |
the index number of the candidate;
|
(e) |
the name of institution, for an institutional candidate;
|
(f) |
all subjects taken by the candidate in the examination and the level of attainment in every subject;
|
(g) |
the aggregate level of attainment;
|
(h) |
a photograph of the candidate where applicable;
|
(i) |
year and series of the examination; and
|
(j) |
any other feature that may be determined by the Council from time to time.
|
|
(7) |
The details of a certificate shall not be changed unless the amendment is to correct an error.
|
|
21. |
Examination Arrangements for Persons with Disabilities
(1) |
The Council may prepare a modified examinations paper for a candidate with special needs.
|
(2) |
The modification shall be based on an appropriate curriculum adopted by the Kenya Institute of Curriculum Development or any other accredited curriculum agency.
|
(3) |
Prospective candidates and head of relevant institution shall provide such information in prescribed forms at registration.
|
(4) |
The County Director of Education shall submit to the Council, at the time of registration for examination the—
(d) |
nature of impairment; and
|
(e) |
degree of impairment of the candidate with special needs.
|
|
(5) |
The duration of examination allowed for a candidate with special needs may be varied by the Council depending on the candidate's degree of impairment.
|
(6) |
The degree of impairment shall be supported by evidence from a qualified professional assessor.
|
|
22. |
Examination Timetable
(1) |
The Council shall provide a provisional examination timetable to relevant institutions and stakeholders in advance for feedback.
|
(2) |
The Council shall provide the final examination timetable to all the heads of institutions and candidates.
|
(3) |
The time allowed for answering questions in every examination paper shall be indicated on the timetable and shall also appear on the rubric of the question paper.
|
(4) |
Where the time indicated in the timetable differs from that printed on the examination question paper, the time in the rubic of the question paper shall prevail.
|
|
23. |
Materials and Equipment for Examinations
(1) |
Any institution presenting a candidate for examination shall be required by the Council to provide the facilities, materials and equipment required for the examination.
|
(2) |
All scripts, projects and other materials submitted to the Council for any examination, whether written or practical, shall be the property of the Council.
|
(3) |
The Council shall not accept responsibility for the loss of or damage to any script, project or coursework materials before such is received by the Council for marking.
|
(4) |
The Council's Mathematical Tables shall be the only mathematical tables allowed in the examination room for use in answering questions unless the instructions on the question paper rubric states otherwise.
|
(5) |
A silent, cordless and non-programmable calculator may be used in answering questions unless specifically forbidden in the rubric of the question paper and Council regulations.
|
|
24. |
Language of Examination
All answers to an examination questions shall be written in the English language except for language subjects other than English, or as otherwise specified in the rubric of the question paper.
|
25. |
Candidates with Medical Conditions
(1) |
A candidate who has been diagnosed by a trained medical professional and has been put on quarantine shall take the examination at a separate examination room provided that the Council receives information from the head of institution through the County Director of Education.

(2) |
The Council shall endeavour to quarantine candidates with different medical conditions in separate rooms.
|

THE KENYA NATIONAL EXAMINATIONS COUNCIL (MARKING OF EXAMINATIONS, RELEASE OF RESULTS AND CERTIFICATION) RULES
1. |
Citation
These Regulations may be cited as the Kenya National Examinations Council (Marking of Examinations, Release of Results and Certification) Rules.
|
2. |
Interpretation
In these Rules unless the context otherwise requires—
"centre organizer" means a principal or head teacher appointed by the Council to be in charge of the administration of the marking exercise in an institution where a Council examination is being marked;
"chief examiner" means an examiner contracted by the Council to be the overall in charge of the marking exercise of a particular examination paper or papers and is to ensure that marking of candidate scripts is carried out in accordance with these Regulations;
"deputy chief examiner" means a Kenya Certificate of Primary Education examiner responsible to the Chief Examiner and coordinates Assistant Chief Examiners in the entire process of marking of Kenya Certificate of Primary Education Examinations at a particular marking centre
"assistant chief examiner" means an examiner responsible to the Deputy Chief Examiner and coordinates Team Leaders in the marking of Kenya Certificate of Primary Education examination;
"co-ordination of marking" means the process of coaching examiners of a particular Council examination paper to ensure that they are able to mark the paper in a uniform way and in accordance with these Regulations;
"examiner" means a qualified teacher or specialist who has been trained and commissioned by the Council to assess or mark a candidate's script in a particular course or examination paper;
"dummy" means a model candidate script used to coordinate the marking exercise;
"examination marking regulations" means a set of regulations used to govern the process of marking Council examinations;
"head of institution" means the head of a school or an academic institution and includes director or manager administrator of an institution;
"marking centre" means a venue approved by the Council to host the marking of a Council examination;
"mark-sheet" means a form used to record the marks of a candidate for a particular examination paper;
"result slip" means a document issued by the Council showing provisional examination results attained by a candidate in an examination;
"team leader" means an examiner in charge of a team of several examiners marking a particular Council examination paper or papers;
"query" means an enquiry or complaint by a candidate, parent, invigilator, supervisor, examiner or any other stakeholder on Council's activities.

PART II – MARKING OF EXAMINATIONS
3. |
Marking of examinations
(1) |
The marking of any Council examination shall be carried out in an institution which has been approved by the Council as a marking centre.
|
(2) |
The Council shall set out a criterion for approval of marking centres.
|
(3) |
The Council may use its registered offices as a marking centre.
|
(4) |
The Council shall appoint examiners to mark Council examinations.
|
|
4. |
Registration and approval of a marking centre
(1) |
The Council may register an institution or any venue that qualifies as a marking centre.
|
(2) |
A venue or institution other than the offices of the Council shall qualify for registration as a marking center if the venue—
(a) |
has been considered a Marking Centre through an application to the administration;
|
(b) |
has adequate accommodation, provides hot water and clean sanitary facilities that provide privacy;
|
(c) |
has clean dining facilities with sufficient cutlery and adequate sitting capacity for a minimum of five hundred persons;
|
(d) |
has adequate working rooms that are well lit (with natural light and electricity), ventilated with burglar proof windows and doors;
|
(e) |
has a secured computer laboratory with not less than twenty modern model functional computers protected with up-to date anti-virus software, power back up as well as Uninterrupted Power Supply (UPS) and interne connectivity, a laboratory with two functional printers of specifications determined by the Council from time to time;
|
(f) |
can secure twenty four hour armed security personnel;
|
(g) |
has recreational facilities;
|
(h) |
has a sanatorium with a qualified nurse and a hospital located nearby;
|
(i) |
can be easily accessible by public transport and communication facilities;
|
(j) |
can be connected to the national grid and have a stand by three phase generator; and
|
(k) |
has the centre organizer or the assistant centre organizer available within the marking centre throughout the marking period.
|
|
(3) |
The Council may review the criteria in paragraph (2) from time to time.
|
(4) |
The Council may deregister and or suspend an approved marking centre which fails to maintain the conditions set out in paragraph (2).
|
|
5. |
Foreign Certificates
Where the Council has approved an institution or venue as a marking centre, the centre organizer shall be expected to—
(a) |
ensure that the marking centre has adequate accommodation, catering, medical, recreational and ICT facilities;
|
(b) |
ensure adequate security to safeguard examination materials, personnel and equipment;
|
(c) |
provide a secure strong room for the storage of examination materials required for the marking exercise;
|
(d) |
monitor the marking exercise to ensure progress under the marking programme;
|
(e) |
appoint assistant centre organizers, temporary employees and assign such officials duties in the management of the marking exercise as specified by the Council; and
|
(f) |
perform other duties that may be assigned by the Council from time to time
|
|
6. |
Monitoring of the marking progress
A centre organizer shall liaise with the Council on the marking progress in every paper marked at the centre.
|
7. |
Categories of Examiners
(1) |
The Council shall have atleast three categories of examiners—
(a) |
chief examiner or examiner-in-charge;
|
(b) |
senior examiner (including assistant chief examiner, deputy chief examiner, and team leader; and
|
|
(2) |
The role of each category of examiners shall be as stipulated under rules 8-10.
|
|
8. |
Role of Chief Examiner or Examiner-In-Charge and Deputy Chief Examiner
(1) |
A chief examiner or examiner-in-charge shall—
(a) |
report to the Council on all aspects of marking;
|
(b) |
take the overall leadership of the examination marking exercise for that paper or papers the chief examiner is in charge of;
|
(c) |
give the Council a cumulative record of the number of scripts marked every day by every examiner;
|
(d) |
give the Council information on the expected completion date of marking of every paper;
|
(e) |
ensure that administrative arrangements at the marking centre are made in accordance to the Council's guidelines and marking regulations;
|
(f) |
select scripts for coordination of marking in accordance with the Council's guidelines on selection of scripts;
|
(g) |
co-ordinate with senior examiners and other examiners before and during the actual marking to ensure that one marking standard is maintained throughout the marking exercise;
|
(h) |
ensure that the Council examination marking regulations are read, understood and adhered to by every examiner;
|
(i) |
ensure that examiners observe marking discipline, are actively engaged in the work allocated to them and are not indulging in any activity that may slow, disrupt or compromise the integrity of the marking exercise;
|
(j) |
prepare confidential reports on senior examiners;
|
(k) |
verify all payment claim forms completed by senior examiners;
|
(l) |
keep an accurate daily attendance register of all examiners marking the paper the chief examiner is in charge of;
|
(m) |
read through confidential reports of every examiner and make recommendations for promotions or reprimanding of examiners; and
|
(n) |
attend meetings to discuss marking programmes upon invitation by the Council.
|
|
(2) |
The Council may disqualify a chief examiner who fails to attend meetings to discuss marking programmes upon invitation by the Council.
|
|
9. |
Assistant Chief Examiners
(1) |
An assistant chief examiner shall be appointed by the Council and shall report to and be assigned duties by the chief examiner or deputy chief examiner.
|
(2) |
The assistant chief examiner shall—
(a) |
coordinate team leaders and the examiners in the marking of Kenya Certificate of Primary Education examinations;
|
(b) |
ensure that the marking regulations are complied with by the examiners under the team leader;
|
(c) |
prepare a confidential report to the chief examiner or examiner on the work of team leaders;
|
(d) |
verify the number of scripts marked by every team leader in their team;
|
(e) |
ensure that the set standard on the marking exercise are maintained; and
|
(f) |
advice the chief examiner or deputy chief examiner on standard as evidenced by the quality of the work of the relevant candidates in the report submitted by other examiners.
|
|
|
10. |
Duties of a team leader
A team leader shall report to the assistant chief examiner and shall have the following duties—
(a) |
participate in the coordination meeting with the relevant chief examiner;
|
(b) |
coordinate examiners in the team under the team leader prior to the marking of live scripts;
|
(c) |
prepare a confidential report on the work of examiners in the team;
|
(d) |
advise the assistant chief examiner on the standards as evidenced by the quality of the work of the relevant candidates in the reports submitted by other examiners;
|
(e) |
assist in any other marking operation assigned by the chief examiner or assistant chief examiner; and
|
(f) |
monitor the security of the marking exercise.
|
|
11. |
Role of an examiner
(1) |
An examiner shall work under the supervision of a senior examiner and shall perform the following duties—
(a) |
attend and participate in the pre-marking coordination meetings;
|
(b) |
mark live scripts according to the marking regulations and marking scheme;
|
(c) |
complete claim forms for scripts marked and submit the forms and scripts to the team leader before leaving the marking centre; and
|
(d) |
prepare preliminary reports on the work of the relevant candidates to be submitted to the team leader for study and necessary advice given to the chief examiner for incorporation into the main confidential report on the work of candidates.
|
|
(2) |
An examiner shall not take a candidate script out of the marking room for any reason whatsoever
|
|
12. |
Marking procedure
(1) |
The Council shall determine and document the procedures and regulations to be followed during marking of all Council examinations
|
(2) |
The Council may review the marking procedures and regulations from time to time.
|
|
PART III – TRAINING AND RECRUITMENT OF EXAMINERS
13. |
Training and recruitment
(1) |
The Council shall establish mechanisms to ensure that examiners are trained.
|
(2) |
The Council may enter into a Memorandum of Understanding with any recognized educational institution to train examiners.
|
|
14. |
Training of examiners
(1) |
(a) |
develop a curriculum for the training of examiners;
|
(b) |
ensure that all examiners are trained using the curriculum developed under paragraph(a);
|
(c) |
develop a criteria for assessment of examiner trainees; and
|
(d) |
award certificates to all successful trainees after training.
|
|
(2) |
The Council may under special circumstances conduct on the job training of examiners for particular papers or courses.
|
(3) |
The Council may review the curriculum for training of examiners from time to time.
|
(4) |
The Council may advertise through the media or other means on training of examiners.
|
|
15. |
Short-listing of examiners
(1) |
The Council shall be guided by the following criteria when short-listing examiner trainees—
(a) |
be a practicing teacher and trainer in the relevant subject areas;
|
(b) |
have a minimum teaching experience of at least three years after graduation;
|
(c) |
be a person of integrity as specified in chapter six of the Constitution of Kenya; and
|
(d) |
has attained academic or professional qualifications specified by the Council.
|
|
(2) |
The qualifications under paragraph (1)(d) shall be—
(a) |
at least P 1 for examiners in the Kenya Certificate of Primary Education and a minimum grade of a C at the Kenya Certificate of Secondary Education examination level or equivalent in the subject or paper applied for;
|
(b) |
at least a diploma for Kenya Certificate Secondary Education, post school and teacher education; and
|
(c) |
be recommended for training by the relevant head of institution.
|
|
(3) |
On completion of training, the successful trainee shall be included in the Council's data base for trained examiners.
|
|
16. |
Criteria for appointment of examiners
(1) |
The Council shall develop standards or criteria for appointment of Examiners.
|
(2) |
An examiner who does not meet these set standards or criteria for marking shall be informed in writing.
|
(3) |
(a) |
be successfully trained as an examiner and be in the Council's database;
|
(b) |
be willing to mark under the Council's marking procedures, regulations and terms and conditions of service;
|
(c) |
be willing and able to keep the marking programme and set marking targets;
|
(d) |
sign and keep the oath of secrecy;
|
(e) |
keep their identity and any information acquired during the marking process confidential;
|
(f) |
refrain from indulging in behaviour likely to disrupt the smooth running of the marking exercise; and
|
(g) |
declare any interest before the start of marking.
|
|
(4) |
An appointment to mark answer scripts shall be made by the Council and such appointment shall cover only one series.
|
(5) |
Once appointed for a particular series, an examiner shall not be required to reapply for subsequent series but shall inform the Council of any changes in particulars.
|
(6) |
The Council shall sign a marking contract stipulating terms and conditions of engagement with each examiner.
|
(7) |
The Council shall reserve the right to terminate the services of an examiner for breach of these rules and any regulations made by the Council relating to the marking of examinations.
|
(8) |
An examiner who does not participate in a marking exercise for two consecutive sessions shall be removed from the Council's examiners data base without reference to the examiner
|
(9) |
An examiner shall account for Council and marking centre property issued to the examiner before leaving the marking centre.
|
|
17. |
Co-ordination of Examiners
The chief examiner will coordinate the question paper and marking scheme to ensure the accuracy of examination.
|
18. |
Marking of examinations
(1) |
The Council shall develop regulations for marking all examinations.
|
(2) |
Examiners shall use the set criteria to mark all examinations.
|
(3) |
After marking a candidate's script, the examiner shall tally all marks attained by the candidate in the examination paper being marked.
|
(4) |
A candidate's script and marks shall not be taken out of a marking center by an examiner or an official at the marking centre.
|
(5) |
An examiner, a center organizer or an official at the marking center shall not photocopy or transfer a candidate's work or marks in whatever form other than the one prescribed by the Council.
|
(6) |
The marking scheme and marking regulations shall not be taken out of the marking centre by any examiner, or a centre organizer or officials at the marking center.
|
(7) |
Notwithstanding paragraph 4 and 6, the center organizer shall return all the candidate scripts and all marking materials to the Council after the completion of marking.
|
|
19. |
Restriction to access of marked scripts
An examination script shall not be accessible to any candidate, institution, teacher or any other third party representing the interest of the candidate once the script has been marked.
|
PART IV – PROCESSING AND ISSUE OF EXAMINATION RESULTS
20. |
Processing of marks and release of examination results
(1) |
The Council shall record and process candidate marks into examination results.
|
(2) |
The Examination results under paragraph (1) shall be released and announced by the Council.
|
(3) |
Examination results released by the Council under paragraph (2) shall be the official results of the Council.
|
|
21. |
Contracted professionals
(1) |
The Council may engage such educationist and other professionals as shall be determined by the Council in the processing of examination results.
|
(2) |
A contracted professional engaged in the processing of examination results shall maintain integrity, declare his or her interest and subscribe to an oath of secrecy.

22. |
Responsibility of heads of institutions
(1) |
A head of an institution shall be responsible for submitting all examination marks regarding the relevant candidate's continuous assessment test, course work, project and teaching practice in accordance with the deadline set by the Council.
|
(2) |
Where a head of institution or relevant person fails to comply with sub-rule (1) the candidate shall not be awarded a Certificate or Diploma.
|

23. |
Issuance of result slips
(1) |
The Council shall issue result slips to successful candidates upon completion of marking, processing and release of examination results..
|
(2) |
The personal details recorded on an examination result slip shall be those provided by the candidate during registration and the grades attained in the examination.
|
(3) |
The results indicated in a candidate's result slip shall be provisional.
|

24. |
Issuance of Certificates
The Council shall issue certificates and diplomas to qualified candidates within twelve months of the release of examination results.
|
25. |
Withdrawal of results or certificates
The Council may withdraw an examination result, a certificate or diploma where the Council is satisfied that—
(a) |
the result, certificate and or diploma was issued and or acquired in a fraudulent manner;
|
(b) |
an examination irregularity was committed before or during the time the candidate sat the examination or before release of the examination results; or
|
(c) |
the candidate sat the examination without fulfilling the minimum examination entry requirement.

26. |
Handling of examination queries
(1) |
A person may lodge a query to the Council on—
(a) |
a candidate's personal details; or
|
|
(2) |
In resolving queries lodged under paragraph (1), the Council shall be guided by, the Act, these Rules, written laws, Council policies, Council procedures and Council regulations
|
(3) |
An applicant submitting any query to the Council for resolution shall ensure the applicant provides all the required evidence to enable the Council process and validate the query promptly.

27. |
Review of examination results
(1) |
A candidate may apply to the Council for review of the decision in respect to the candidate's examination results or data under the Act, these Rules or any other written law.
|
(2) |
A review under paragraph (1) shall be lodged to the Council by the candidate within thirty days from the date of release of the examination results
|
(3) |
An application for review under paragraph (2) shall be made to the Council in writing.
|
(4) |
The Council shall upon receiving an application for review, consider the application and make a decision.
|
(5) |
In determining an application for review, the Council may—
(b) |
approve part of the request; or
|
|
(6) |
A decision made in response to the review shall be in writing and shall be communicated to the applicant within ninety days from the date of receipt of the application.
|
(7) |
The decision of a review under these Rules shall be final.
|
|
28. |
Conditions for Change of certificates
(1) |
A candidate shall be required to return an original certificate, diploma or result slip initially issued to the candidate by the Council in case any change has been effected by the Council on the results slip, certificate or diploma.
|
(2) |
A candidate shall return such a certificate before the corrected result slip, certificate or diploma can be issued to the candidate.
